The General Assembly, Recognizing that GAR #374 “The Rule Of Law is a pivotal piece of legislation that upholds the concept of there being a “Rule of Law” that no entity in society is above, not even government institutions or the socioeconomic elite in a given nation, Noting, however, that GAR #374 is fatally flawed due to Article 2(a), which “Declares that reasonable, good faith exceptions may be made in instances where... some form of immunity is necessary to ensure that government employees or institutions may carry out essential functions that would not otherwise be possible without the guarantee of immunity…”, Unconvinced that any hazard, difficulty, or misplaced benefit of the doubt renders any extent of pre-determined or non-fact-based immunity "necessary" for government officials, other than in regards to legislative immunity, Unsettled by the prospect that those individuals and institutions entrusted with the right and ability to use violence and force against civilian populations in the interest of keeping law and order, such as in the form of law enforcement forces, could be exempted from liability and responsibility for their actions; which in turn would breed an unjust and false sense of impunity in the abuse of their exclusive right to administer violence and force, Believing that, with the exception of legislative immunity, it is preferable to ensure all government officials and institutions are answerable to the law and civil action for the consequences of actions taken in their respective capacities, regardless of their position or function as government officials and institutions, rather than to allow incompetence and malice from these entities to go unchecked, Resolved that a replacement resolution is needed to truly enshrine the spirit of GAR #374 in law whilst eradicating baseless immunity for government officials and institutions, Hereby repeals GAR #374 “The Rule Of Law”. "The Rule of Law" gives exceptions for functions which require legal immunity and in cases where legal clemency is granted. This repeal argues that such exceptions are unacceptable, especially considering individuals and institutions with the ability to use violence to maintain order (such as law enforcement), who arguably ought to have their power checked through legal accountability. The WADB will share information on potential disasters with relevant member states, providing disaster response plans if necessary. In addition, groups must apply routine maintenance to systems "prone to disasters in the case of failure of said systems," creating and submitting risk assessments to the WADB. The Alliance believes that such requirements will simply create an extra, unnecessary layer of bureaucracy when dealing with natural disasters. In areas prone to disasters, detection and mitigation programs generally already exist; the necessity of requiring such plans to be approved by the WADB is therefore unclear. Furthermore, relying on recommendations created by the WADB may prove harmful in situations where quick and decisive action is required by local authorities, which is generally the case for severe disasters. The United Regions Alliance recommends that you vote AGAINST the resolution This resolution, in support of the principles of the rule of law, requires all individuals and institutions to be held accountable for any actions they take based on all applicable laws in their jurisdiction. Member states are also required to "have the principles of the supremacy of the law and accountability to the law enshrined" in their law. Lastly, this resolution allows the extension of legislative immunity to anyone responsible for conducting "legislative activity" and the issuing of clemency towards people or institutions. The Alliance takes issue with the wording of the final clause of this resolution. Allowing full legal immunity for those involved with vaguely defined "legislative activity" simply enshrines the protection of corrupt politicians under the law. Additionally, lobbying organizations (such as corporations, powerful private individuals, etc.) could be considered to conduct legislative activity, thereby extending such immunity to them as well. For that reason, the URA cannot support this resolution. The United Regions Alliance recommends that you vote AGAINST the resolution This declaration expresses its opposition to the practice of quorum raiding, which this resolution defines as "the act of unseating delegates approving a World Assembly proposal in order to prevent the approved proposal from reaching quorum." The resolution declares that all militaries should cease quorum raiding except as a last resort for preventing hateful propaganda. The Alliance strongly disagrees with these suggestions; limiting the ways in which regional operators can combat fascism in the WA is not a policy to be supported. Leaving quorum raiding as a last resort could allow hateful resolutions to sneak through the queue and enter voting procedures. This General Assembly resolution was written by Wallenburg to repeal "Preventing the Execution of Innocents," which was written by Imperium Anglorum. The United Regions Alliance recommends that you vote FOR the resolution This resolution repeals GAR#443 "Preventing the Execution of Innocents," which mandates certain legal procedures and rights to those being prosecuted for capital offenses. "Preventing the Execution of Innocents" was written before capital punishment was totally abolished by "Death Penalty Ban" and "Military Death Penalty Ban". That fact by itself lends support to repealing GAR#443. This repeal argues that aspects of GAR#443 "make a mockery of justice" through measures such as needlessly expanding WA bureaucracy to deal with every single capital punishment case and requiring an impossibly high burden of proof for conviction. This is coupled with numerous loopholes which outright prevent capital punishment, such as giving the defense and the Division twelve months to review a verdict while requiring executions to occur within a year or requiring a suffering-free execution method. The Alliance recognizes the huge flaws in "Preventing the Execution of Innocents" due to its overbearing requirements and numerous loopholes, and furthermore believes it to be completely obsolete anyway due to "Death Penalty Ban." Therefore, the URA strongly supports this repeal effort. The Federation of URA World Assembly Affairs URA World Assembly Recommendation Protections During Territorial Transitions The General Assembly, Aware that territorial transitions between member states may occur as part of trade agreements or other diplomatic proceedings; and Affirming that sovereign states have the right to manage their territory as they see fit; and Applauding previously passed legislation and its mandate that member states allow their inhabitants to fulfil their basic needs; yet Concerned about the fate of those inhabitants that must endure the effects of territorial transitions; Hereby:

The United Regions Alliance recommends that you vote AGAINST the resolution This resolution creates a series of regulations on territorial transitions. Inhabitants of a transitioned territory must be offered a right to residency in the receiving state, the right to relocate out of that territory back into their home country, and assistance with integration into their new state. While the Alliance recognizes the good intentions of this resolution, it has some concerns about its mandates. Firstly, in the case of a mass transition clause 5 (which requires states to aid citizens "unable to see to their basic needs as a result of relocating") can be temporarily ignored. This effectively means that in mass territorial transitions, which are generally periods of decreased stability and economic security, starving people in a foreign country will receive minimal assistance. Furthermore, in cases where the inhabitants of a transitioned territory become a cultural minority in their new country, clauses 7 and 8 may encourage assimilation and replacement of local culture with that of the new owner. For these reasons, the URA does not support this resolution. The Federation of URA World Assembly Affairs URA World Assembly Recommendation Repeal: Elections and Assistance Act General Assembly Resolution #130 "Elections and Assistance Act" (Category: International Security; Strength: Mild) shall be struck out and rendered null and void. The General Assembly, Noting that promoting democratic transitions and democracy is a noble goal and is indeed the purpose of this resolution, but Believing that this resolution, while well intentioned, falls well short in a variety of ways in regards to promoting democratic transitions, Acknowledges that the “encouragement” of Article 2, Section 3 is self-defeating in that the lack of mandate on member states to have an independent, even if state-affiliated, body to conduct elections can lead to abuse by interested parties on their favored candidate or side’s behalf thus undermining the very principle of free and fair elections and opening up the potential for manipulation of elections through corrupt practices; Notes that the lack of an explicit mandate to be rid of electoral systems with an in-built “disproportionate advantage”, as in Article 2, Section 4 allows for the creation of election systems which, while ostensibly fair, do in the end bias some constituency over another and that the lack of a mandate for fair electoral systems here undermines considerably the creation of fair systems as noted in Article 3, Section 2 by the Organization for Election Assistance (hereinafter the OEA) as member nations could conceivably cite obviously flawed systems as fair as there are no mandates to the contrary; Recognizes that the non-binding nature of Article 3, Section 2 undermines Article 3, Section 3 as while the OEA may assist in the creation of electoral systems, there is no mandate for nations which call on the OEA's assistance to craft fair electoral systems, thus defeating any purpose that the OEA’s advisory capacity may have in establishing “democratic principles”; Observes that Article 3, Section 4’s provisions for voluntary election monitoring, on the proviso that the OEA is asked, is contradicted by Sections 5 and 6 which set up mandatory oversight and monitoring provisions which do not require a nation’s consent for implementation; Discerns that Article 3, Section 5’s provisions for the monitoring of unfair practices do not provide for an investigatory role, only an oversight one, thus hindering the ability of the OEA to deem elections as “free and fair” as there is no mechanism to prove definitively that voter fraud, voter intimidation, or vote buying occurred as there is no way for the OEA to effectively gather data except for through non-compliance proceedings; Sees that “reasonable consideration” as noted in Article 3, Section 7 is not defined in non-binding OEA vote counts, thus leaving the door open for malign member state actors to potentially disregard the OEA’s tally in electoral disputes, thereby throwing earlier mandates for fair conduct into doubt and disrupting any utility that the monitoring powers granted to aforementioned body in Article 3, Section 6 might have in ensuring that "transitioning nations" successfully conduct free and fair elections; and Noticing these faults with this resolution as a whole and deeming it unsatisfactory; Hereby repeals GA #130 "Elections and Assistance Act". RECOGNIZING that free and fair elections are vital to the preservation and success of democratic institutions, ACKNOWLEDGING that nations transitioning from a non-democratic system of government to a democratic system of government face special challenges in both forming an electoral system and ensuring the legitimacy of elections themselves, RESOLVED that all nations who choose to have elections should comply with certain common expectations of what constitutes a free and fair election, The World Assembly hereby enacts the following: Article I - Definitions Sec. 1. "Public office" shall herein mean any office of a government that is subject to an election, whether that election be direct or indirect, popular or otherwise. Sec. 2. A "plebiscite vote" shall herein mean any vote put forth for the public to decide on an issue where the public’s vote is binding. Article II - Principles of Free and Fair Elections Sec. 1. Where all direct elections are held for public office, a secret ballot shall be used, whereby no person’s vote shall be involuntarily disclosed to the public. Sec. 2. In all elections for public office, the aggregate results of the elections shall be made publicly available and open to scrutiny. Sec. 3. Nations are encouraged to establish an independent body or bodies to monitor and officiate all elections for public office. Sec. 4. Nations are encouraged to use a vote-counting methodology that does not provide a disproportionate advantage to any candidate or groups of candidates. Article III – Assistance Sec. 1. To assist nations transitioning from a non-democratic to a democratic form of government, hereinafter "transitioning nations," the Organization for Electoral Assistance (OEA) is established. Sec. 2. The OEA shall assist creating electoral systems in transitioning nations when called upon by those nations for that purpose. Sec. 3. As an advisory body, the OEA shall not have any binding authority on creating electoral systems, but shall strive to promote democratic principles, including universal suffrage and voting accessibility. Sec. 4. The OEA shall monitor elections and plebiscite votes in transitioning nations, when asked to do so and only in the capacity agreed upon by the transitioning nations in question, excepting the mandatory provisions in Sections 5, 6, and 7 of this Article. Sec. 5. The OEA must have access to voting locations without undue interference, to monitor possible fraud, voter intimidation, ballot tempering, and other unfair and fraudulent activities. The OEA shall make publicly available any all reports of the previous to the press and relevant institutions. Sec. 6. The OEA must be allowed to either observe and monitor the tallying of votes or be a party therein. Sec. 7. If the OEA serves in an observational capacity, OEA vote counts shall be nonbinding; however they should be conferred reasonable consideration in electoral disputes. If the OEA serves as a party in vote tallying, OEA vote counts shall be binding. Sec. 8. Member nations are encouraged to assist in monitoring non-member transitioning nations’ elections and plebiscite votes, per consensual terms and conditions. Article IV – Clarifications Sec. 1. Nothing in this Act shall be construed to require elections in nations where no elections are currently held. Sec. 2. However, nothing in this Act shall be construed to deny the peoples' right to self-determination. The United Regions Alliance recommends that you vote FOR the resolution This resolution repeals GAR#130 "Elections and Assistance Act," which mandates the use of secret ballots open to scrutiny and creates the Organization for Electoral Assistance; the OEA helps transitioning nations and monitors their developing democratic institutions. This resolution identifies numerous flaws with GAR#130, such as not requiring the creation of an independent national body to oversee elections, not requiring the use of "fair" electoral systems, allowing member states to disregard the OEA's vote counts, and only setting up the OEA as an observational body rather than an investigatory one. The Alliance agrees that the flaws with the original resolution allow malicious actors to unfairly influence elections and in some cases entirely ignore the OEA. It does not legislate on the legality of producing, distributing or trafficking drugs. While the intent behind decriminalization is well received, the all-encompassing nature of this resolution leaves serious flaws in this resolution. While (to humans) drugs like marijuana are relatively harmless, this resolution also decriminalizes more dangerous drugs. One example is Bath Salts, which can induce paranoia, hallucinations, lower pain reception, violent tendencies etc. which combined can lead to serious harm towards both the user and bystanders; furthermore, long term side effects after repeated use pose their own public health and safety risks. This resolution also does not deal with the important subject of rehabilitation, although rehab will apparently be part of a separate resolution. The United Regions Alliance recommends that you vote AGAINST the resolution This resolution creates the Health and Safety Board (HSB) to analyze worker safety and injury data from member states, and ensure member states enforce the dissemination of safety manuals. These Manuals establish safety standards for workers and workplaces, such as Material Safety Data Sheets. While the URA may agree with the principles behind this resolution, its poor writing means the Alliance cannot support "Health and Safety Act." For no clear reason, the definition of worker is based upon the average build of a predominant species. In a society with more than one species, the minority species will be totally ignored, and standards for the predominant species may even put the minority species at greater risk. This definition also assumes that the predominant species has an "average build;" in the case of an ant species, different individual ants would have different builds based upon their biological role. Unlike with humans, defining any given build as "average" would be wholly inappropriate. This resolution's preamble also suffers from poor writing, with phrases like "as small a risk" and "make a quick buck." The Alliance is unsatisfied with clause six, which requires the Office of Electoral Administration to investigate all "allegations of voter intimidation, voter fraud, and other fraudulent or dishonest practices relating to elections" that they oversee. A malicious actor could easily allege fraud in every single ballot -- even with no evidence -- requiring the OEA to undergo a pointless and tedious exercise in recounting millions of valid ballots. Additionally the vague phrase "dishonest practices retaining to elections" does not necessarily limit itself to electoral fraud. If a candidate makes a misleading claim, would that be a dishonest electoral practice?
