Senate of the Damned

i- The concerned shall file a petition and present their case

ii- The court judges will review and vote in private if they shall grant or deny approval

iii- The court shall declare it's decision

iv- The court may deny approval if a majority of Judges believe the case lacks jurisdiction, evidence, standing, or constitutional relevance, and present reasoning for denial

v- If approval granted, all involved parties shall be summoned before the Court by the Head Of Injustice and informed of all charges, accusations, or claims against them. Both parties shall possess the right to present arguments, rebuttals, testimony, and evidence

vi- The judges will listen, ask questions for clarification of facts, and voice their concerns while standing on neutral ground

vii- Only the judges, the King, and the relevant parties may participate in the RMB for the court proceedings

viii- Any demon wishing to voice their opinion on the matter may reach out to either party who shall then tag them to speak from their behalf

ix- Anyone wishing to give a neutral opinion may approach the judges and present their opinion

x- The judges will discuss and vote in private on the decision

xi- The judges may consult the Court Archives for any previous case of the same nature to ensure continuity & stability of an established precedent while preventing any new interpretation of the manuscript or passing of conflicting judgments for the same offences

xii- The judges will then present the majority vote and their reasoning for the said decision

xiii- Final decision shall be issued publicly alongside legal justification by the court and any reference applicable to the Manuscript, decree, or any established precedent

xiv- The decision will be a binding legal order

xv- All case proceedings may be preserved in summary within the Court Archives to set future precedent

I- All Damned citizens have the right to petition and a fair trial

II- The losing party may approach the Hell Elders for appeal on the ruling, who shall then judge accordingly

III- In case the Hell Elders accept the appeal, the court order shall still stay binding until the Elders override the decision by a majority vote

IV- The court proceedings shall be overseen under the careful watch of The Head Of Injustice who shall:

a) Order summons
b) Grant approval to witness testimonies
c) Grant approval to demons wishing to voice their opinion
d) Announce the final judgment
e) Announce prosecution of an individual accused of court contempt

V- All present in the courtroom are required to remain civil, not lose their cool, and practice court etiquette (no personal attacks, no abusive language)

VI- Any demon in breach of court etiquette shall be given warning. Repeated offence shall be suppressed by the judges and may constitute contempt of court

VII- Disruption of proceedings, refusal to comply with Court orders, witness and evidence tampering, or interference with judicial process may constitute contempt of court and the individual shall be prosecuted to face trial in the court

VIII- Any intentional refusal to the court summons shall be notified to the King or the Hell Elders

IX- The court may accept formal public apology from those responsible of court contempt and may not prosecute them provided that they don't repeat the offence

X- Judges of the Court of the Damned shall not be removed during active proceedings except by a majority Elder vote or voluntary resignation in order to protect them from external pressures and threats

XI- Attempts to coerce, intimidate, threaten, improperly influence, or retaliate against a Judge regarding judicial proceedings shall constitute contempt against the court and shall be prosecuted

XII- All parties, government officials, Elders, and judges shall refrain from making public statements intended to improperly influence judicial proceedings, pressure the Court, or rally public support regarding matters currently pending before the Court. This however, does not prohibit voluntary confessions, personal defense statements, or factual discussion of the case

XIII- Any Judge possessing direct personal involvement, political conflict, prior participation, affiliation, or a demonstrated bias regarding a case before the Court may recuse themselves from proceedings of the said case to prevent biased judgement, grudges, or rivals/friends judging eachother

XIV- In the event of recusal, resignation, or suspension, a temporary judge may be appointed by the same appointing authority responsible for the original judge, to maintain fairness and a balance of power

XV- Any absent or inactive judge for atleast a week or more without notice may be temporarily replaced by the same appointing authority responsible for the original judge to serve for the duration of their absence or inactivity. In case of notified absence, the court may await their return

XVI- All who enter the court to testify may take the following oath:

“I, [nation name], standing before the honourable Judges of the Infernal Kingdom and beneath the gaze of the King of Hell, do solemnly swear upon my soul, my blood, and the eternal fires, that I shall speak the truth unbroken by deceit, omission, or cowardice.

May the abyss bear witness to my words, and may the flames of damnation consume my honour should I knowingly speak falsehood before this court. I submit myself to the judgment of the Crown & the Law of Hell.

By the Throne of Hell and Satan's name, I so swear”

XVII- Judges may begin the court proceedings by taking a judicial oath:

“I swear before Hell and the Damned to render judgement without fear, favouritism, malice, or corruption; to uphold the Manuscript of the Damned; and to preserve the integrity of Infernal Injustice”

XVIII- The Court of the Damned (being the supreme judicial authority) shall, by majority vote, may review and rule upon the constitutionality of any law, decree, or policy alleged to conflict with the Manuscript of the Damned. Any provision found in violation of the Manuscript may be declared unconstitutional and rendered void by the Court unless it is overturned through lawful appeal to the Hell Elders

XIX- Prior precedent may guide judicial interpretation but may be reconsidered if the Court determines previous interpretation conflicts with the current Manuscript or evolving constitutional necessity as the Manuscript undergoes future changes

XX- Denial of testimony, participation, or evidence by the Head of Injustice may be reviewed by majority vote of the Court

XXI- During prosecution, the individual will be questioned on their actions and they may present arguments in their defense
After the prosecution trial, the final decision and penalty shall be declared by the Judges

XXII- While immune from ordinary prosecution, the King of Hell remains bound to preserve the integrity, stability, and order of the Kingdom

Contempts of court shall include but not limited to:

1- Civil Contempt:
These pertain to civil offences:

i- Willfully disobeying or disregarding a final court order

ii- Willfully refusing to answer the judges' questions or to their summons (refusal to participate in the court proceedings)

2- Judicial Contempt:
These are offences related to the Court and Judges:

i- Scandalizing the court (attack, insult, or undermine the authority, integrity, and dignity of the judiciary)

ii- Personal attacks against a judge, or dismissing their judicial authority during a trial

iii- Using various methods to attack & insult, with the aim to diminish and undermine the authority, integrity, dignity and respect of the Court Of The Damned in the eyes of Hellions

iv- Any Judge in breach of court etiquette or involved in personal attacks, abusing, issuing threats, or intimidating any party during court proceedings

3- Criminal Contempt:
These pertain to offences that sabotage the trial:

i- Willfully obstructing and interfering in the process of law and jeopardising the court's ability to conduct a fair trial

ii- Submitting knowingly falsified or altered evidence in the court

In lightless darkness of the contempt of court, the judges by a majority vote shall prosecute the individual

Any demon may be prosecuted for contempt of court with the following conditions:

I- The King of Hell shall remain immune from ordinary prosecution

II- Allegations of grave constitutional misconduct, abuse of royal authority, or actions threatening the stability of Hell attributed to the King, The Satan's Chosen, or the Hell Elders may be reviewed exclusively by the Hell Elders

III- The individual under prosecution shall halt their legislative duties during the duration of the trial

IV- The judges cannot be prosecuted based on their rulings or errors in judgment

V- Any official found guilty after a prosecution trial may become subject to impeachment, or other lawful disciplinary action under applicable constitutional procedures

VI- A prosecution trial involving a Judge shall be overseen by the non-accused Judges while the King may serve as the temporary third Judge in-place of the accused Judge
