The Office of Deputy Secretary-General UPC Recommends Voting AGAINST "International Nuclear Compliance Commission"

This proposal seeks to establish the International Nuclear Compliance Commission (INCC) as a regulating body of the World Assembly for nuclear energy. The intend is for the INCC to publish and maintain lists of regulations around nuclear energy, assist member nations in their efforts to achieve criticality and audit the nuclear energy infrastructure of member nations. Further it establishes two organizations under the aegis of the INCC. First, the Advisory Committee on Reactor Safety (ACRS), to advise on the safety of proposed and existing nuclear facilities. Secondly, the Emergency Nuclear Response Organization (ENRO), to coordinate emergency responses to nuclear disasters.

While this proposal's aims are certainly noble and worthy of being enshrined in international law, it is sadly riddled with multiple critical flaws. These flaws already start in the definitions, with the definition of "Nuclear Energy" possibly excluding any nations that maintain a singular nuclear facility, and a completely unnecessary definition of "SCRAM" which is only used once and could have easily replaced with a non-jargon term. Section 2 Clause C tasks the INCC with auditing and ensuring compliance with regulations passed by the INCC, yet any facility inspections require consent by the member nation, which they can deny without any penalties, as the proposals does not grant the INCC any power to enforce any kind of consequences for non-compliance.

All in all, the INCC as described by the proposal, would be a organization task with regulating a critical industry, without any way to effectively do anything but publish non-binding guidelines and strongly worded letters of disapproval in case of non-compliance. Therefore, the Ministry of World Assembly Affairs recommends a vote AGAINST this proposal
