CONSTITUTION OF THE UNION OF EUROPEIAN SOCIALIST REPUBLICS

Article One
Structure of Government

Act of Union

The two nations, the Republic of SpaghettiTopia and the First Republic of Greater Rubisland, for security, prosperity, and the welfare of its people, will henceforth be united under one supreme government. This act of union will create one new nation: the Union of Europeian Socialist Republics.

Branches of Government

Lower House / People’s Assembly

The lower house will be an assembly of 200 locally-elected officials, with each republic of the union gaining 100 seats respectively. When a 2/3rds majority supports a bill, the bill is ratified into law. However, the assembly does not have the right to decide matters of private industry, international relations, and deregulation.

Upper House / Supreme Council

The executive branch will consist of 10 predetermined supreme council members, with each republic of the union allotted 5 slots respectively — including their head of state. They will determine foreign policy decisions such as the declaration of war, economic sanctions, etc. They also reserve the authority to veto any and all assembly legislature only through a unanimous vote. Additionally, they have the capacity to promote, dismiss, and supervise the members of the Supreme High Command of the United Red Forces — however, they do not assume any direct military power themselves.

Two Entities, One Federal Union.

Each republic of the union has the right to self-governance to a certain degree; this includes the appointment of a head of state and a legislative assembly, respectively. However, each republic is forbidden to act independently from the union in international relations and/or against union-wide policies passed by the people’s assembly.

Socialism

Private enterprise of any kind is strictly prohibited within the union, federally and state-level. Punishments for the infraction of this law may vary between severity and the area of the crime committed. If the union persists, this law can not be changed by parliament, by amendment, by the supreme council, or by any other means.

Constitutional Revisions

Amendments to this constitution can be permitted within a 2/3rds majority vote of the parliament. These amendments will be additions to this constitution to reflect the current attitudes of the people, parliament, and of the nation.

Article Two
Rights of member states.

Weapons of Mass Destruction

Republics of the union are entitled to the combined nuclear arsenal of all member states. However, using these weapons — particularly in war and/or against foreign threats, must be allowed unanimously by the executive council.

Legislative Process

Republics of the union are allowed to pass state-level laws that will specifically apply only to their territories. However, all members must abide by union/assembly-level laws and amendments, which take legal precedence before state laws.

Military Forces of the Union

A new federal military will be established: the United Red Forces. The union will take a considerable portion out of each republic’s own military capabilities to make up the federal forces. Command of this federal military will be delegated to a Supreme High Command of the United Red Forces, which will oversee most military matters at the federal level, including but not limited to military campaigns, fronts, grand operations, and union-wide military doctrines. However, operational control is tied to the respective units and their commanders — not the supreme headquarters.

Amendments

Amendment I

To ensure the protection of the people’s right to a democratic nation, member states are required to elect their heads of state and members of parliament democratically, with no restrictions on the race, gender or birthplace of a citizen.

Amendment II

The People's Assembly will elect a Parliamentary Representative every 3 years. This Parliamentary Representative can draft amendments, laws and other changes to the constitution, but will not have the power to veto or pass those changes.
