With the aim of establishing a workers' state and a communist society, in solidarity with all other peoples, free of all exploitation, where every Aryaxian is granted the highest dignity, an acceptable quality of life and equal opportunity,
Hence writes, with the popular approval of we Aryaxian citizens by means of our free vote, the following

Constitution of Aryax
Chapter 1: On the Foundations of the State

  • Article 1. Aryax is a socialist State of free workers, organized by its society and for the good of all its society as a unitary democratic Republic led by the People's Revolutionary Movement, and based on the values of political freedom, social justice, individual and collective welfare, and solidarity.

  • Article 2. National sovereignty resides solely in the Aryaxian people, from whom emanate all powers of the State. All citizens have the right and duty to protect by all means, including armed struggle, the political, social and economic order specified in this Constitution.

  • Article 3. The State's official name is the People's Republic of Aryax, its sole nationwide official language is the Aryaxian language and its capital is the city of Arkanoviverna.

  • Article 4. The sole official flag of the People's Republic of Aryax is a black-red-black tricolor fimbriated by thin white bands and with the National Emblem at its center, in the proportions specified by law. The National Emblem is the Revolutionary Emblem of Aryax. The National Anthem is the Popular March.

  • Article 5. The State officially recognizes no religion.

  • Article 6. Within the territory of the People's Republic, nobility titles are recognized, except as needed for diplomatic relations with foreign nations. Citizens of the People's Republic of Aryax may not accept a nobility title given by a foreign nation.

  • Article 7. The economy is directed by the State, in the manner established by law, under a socialist system free from exploitation. Private property is recognized only in special cases as specified by law.

  • Article 8. The socialist system of the People's Republic of Aryax is protected by the Popular Army and the Supreme Court.

Chapter 2: On Citizenship and Fundamental Rights and Duties

  • Article 9. Aryaxian citizenship is obtained by birth or by naturalization. Any Aryaxian citizen is under the protection of the State regardless of domicile.

  • Article 10. Citizenship by birth is voluntarily acquired by all children of Aryaxian father or mother.

  • Article 11. Naturalization shall take place in the manner established by law. Naturalized citizens shall have the same rights and duties as citizens by birth.

  • Article 12. Citizens of Aryax may not be deported nor extradited to other countries.

  • Article 13. The legal age of majority in Aryax is set at 18 years old.

  • Article 14. Discrimination based on age, caste (where applicable), ethnicity, language, name, race, region or place of origin shall not be tolerated.

  • Article 15. Gender equality shall be respected within the limits of basic biology.

  • Article 16. All citizens are granted the right to life, health and physical activity, education, adequate housing, safety, equality of opportunity and work, as provided by the State and its socialist system.

  • Article 17. Working in Aryax's socialist society is a fundamental right and duty. Unemployment shall not be tolerated. All workers shall have the right to adequate rest, as provided by law.

  • Article 18. The State shall actively protect all workers incapacitated by age, disability or sickness, as well as their families if needed. The State shall guarantee workplace safety.

  • Article 19. The State is the guardian of morality, and shall protect and enforce Aryaxian cultural and social norms.

  • Article 20. A citizen or resident can only be formally accused or prosecuted by a competent court according to national laws that precede the presumed crime and due process established by law. All formal defendants shall be granted adequate defense by the State upon legal request.

  • Article 21. All citizens shall have the right to petition and send complains to the authorities and receive due response in no more than a period of time set by law.

  • Article 22. Law-abiding citizens shall be granted inviolability of the person and the home.

  • Article 23. All citizens and residents have the duty to take care of public and social property, to respect workplace discipline as well as the rights of all other people, and attend and fulfill their civic and social duties.

  • Article 24. All citizens shall unquestionably safeguard the ideological unity of the nation, and observe the laws of the State and the socialist standards of life.

  • Article 25. Serving the Popular Army for a period of time set by law is a duty of every citizen and its highest honor. Treason to the Motherland is the most serious of crimes.

  • Article 26. It is a fundamental duty of all people in the sovereign territory of the People's Republic of Aryax to respect and obey this Constitution.

Chapter 3: On Family

  • Article 27. The family is the most fundamental unit of Aryaxian society.

  • Article 28. Marriage is hereby defined as the voluntary union of a man and a woman with legal aptitude for it as established by law. Formalization and dissolution of marriage, as well as its rights and duties shall be set by law.

  • Article 29. The State shall not make any distinction between children born in or outside marriage.

  • Article 30. Children shall be subject to special legal protections to guarantee their rights. Children under the age of 16 shall not be subject to work.

Chapter 4: On Education and Healthcare

  • Article 31. The State shall promote education, culture and science in all its forms, with particular attention to the goal of building a communist society.

  • Article 32. The State shall guarantee free access to compulsory education as well as the possibility that every worker reaches the highest possible levels of knowledge.

  • Article 33. Artistic creation is free in the manner set by law.

  • Article 34. Scientific development shall be given special priority by the State.

  • Article 35. The State shall guarantee free access to healthcare and preventive care to all its citizens.

  • Article 36. The State shall protect the environment and natural resources for the good of all present and future generations. It is a duty of every citizen and resident to contribute to this protection and goal.

Chapter 5: On the Organization of the State

  • Article 37. The People's Assembly is the supreme organ of State power, and the only legislative organ of the People's Republic of Aryax.

  • Article 38. The People's Assembly shall be elected at least every five years through universal, equal and direct suffrage by secret ballot, following a procedure set by law.

  • Article 39. When unavoidable circumstances render an election impossible, the term of office is prolonged until the election can take place.

  • Article 40. The People's Assembly shall choose its own President, Vice President and Secretary in the manner set by law.

  • Article 41. The People's Assembly shall choose a National President through a simple majority free vote, who shall then choose a Cabinet.

  • Article 42. The Cabinet chosen by the National President is the only executive organ of the State. The National President shall be the head of State and of the Government.

  • Article 43. The People's Assembly:

    1. Is empowered with the legislative initiative;

    2. Shall approve, abolish or amend the laws of the People's Republic;

    3. Shall supervise, amend and enforce the Constitution, and decide on the constitutionality of all laws and decrees;

    4. Shall approve the National Budget and the economic development plans designed by the Cabinet;

    5. Shall approve the establishment of new provinces and municipalities;

    6. Shall have the right to create special commissions;

    7. Shall exercise the highest fiscal control over all organs of the State;

    8. Shall exercise any other function assigned to the highest body of state power by the Constitution and law.

  • Article 44. All elected members of the People's Assembly shall attend its sessions without exception. Any absence must be duly justified and notified to the President of the People's Assembly.

  • Article 45. All decisions by the People's Assembly shall be chosen by a simple majority of its elected members.

  • Article 46. The President, Vice President and all other judges of the Supreme Court, as well as the Prosecutor General and Vice Prosecutor General of the People's Republic, shall be chosen by the People's Assembly in the manner set by law.

  • Article 47. The President of the People's Assembly:

    1. Shall preside over the sessions of the People's Assembly and ensure the application of its regulations;

    2. Shall propose the draft agenda for the sessions of the People's Assembly;

    3. Shall organize the international relations of the People's Assembly;

    4. Shall preside over the special commissions created by the People's Assembly;

    5. Shall exercise any other function assigned to the President of the People's Assembly by the Constitution and law.

  • Article 48. The Cabinet:

    1. Shall have the right to issue binding decrees and submit proposals to the People's Assembly;

    2. Organizes and directs the execution of the political, economic, cultural, scientific, social and defense activities of the State;

    3. Shall design and organize the economic development plans, and once approved by the People's Assembly, direct and control them;

    4. Shall direct the People's Republic's international relations;

    5. Shall design, and once approved by the People's Assembly, control the National Budget;

    6. Is tasked with providing internal security and organizing the defense of the People's Republic;

    7. Directs the administration of the State, and unifies, coordinates and supervises the activities of the organs of the Central and Local Administrations;

    8. Executes decrees and the laws of the People's Republic;

    9. Shall set the date of elections, always in accordance with the provisions of this Constitution;

    10. Shall have the right to declare war and sign peace treaties;

    11. Shall appoint and remove the representatives of the State in foreign nations;

    12. Shall approve or reject the representatives of foreign nations in Aryax;

    13. Shall ratify or denounce international treaties;

    14. Shall exercise any other function assigned to the Cabinet by the Constitution and law.

  • Article 49. The National President:

    1. Represents the State and the Government and directs their general policies;

    2. Attends and controls the development of the activities of the Cabinet and other central institutions of the State;

    3. Presides over and directs the meetings of the Cabinet;

    4. Shall choose the members of the Cabinet, accept their voluntary resignations and decide their substitutions;

    5. Is the Supreme Commander of the Popular Army;

    6. Shall sign all decrees and other decisions adopted by the Cabinet;

    7. Shall exercise any other function assigned to the National President by the Constitution and law.

  • Article 50. In case of incapacitation, sickness or death of the National President, a previously chosen successor that is member of the Cabinet shall temporarily take over until the next election.

  • Article 51. The members of the Cabinet:

    1. Shall each direct their corresponding Ministry or Agency;

    2. Dictate, when it is not an express attribution of another organ of the State, the required regulations for the execution of laws and decrees that concern them;

    3. Shall attend and have a voice and a vote the meetings of the Cabinet, and submit to it the necessary decree proposals;

    4. Shall nominate the corresponding civil servants.

    5. Shall exercise any other function assigned to them by the Constitution and law.

  • Article 52. All citizens, state-owned enterprises and institutions shall give the Cabinet or the People's Assembly the necessary information to fulfill their duties.

Chapter 6: On Administrative Divisions

  • Article 53. The national territory of the People's Republic is administratively divided in provinces and municipalities.

  • Article 54. Municipalities shall have their own legal personality and are governed by the corresponding Municipal Council, appointed by the corresponding Mayor.

  • Article 55. Municipalities shall be grouped in provinces, which shall have their own legal personality and are governed by the corresponding Provincial Council, appointed by the corresponding Delegate.

  • Article 56. All Delegates shall be appointed by the Cabinet. All Mayors and Vice Delegates shall be appointed by the corresponding Delegates.

  • Article 57. Within the territorial limits of their authority, the Provincial Councils:

    1. Shall comply with and execute national laws;

    2. Shall approve and control the economic plan and budget of the Province;

    3. Shall organize the operation of entities responsible for carrying out economic, educational, health, cultural, sport, environmental protection and recreation activities, production and services subordinated to them;

    4. Shall maintain fiscal control over Municipalities;

    5. Shall revoke or modify all provisions from subordinated entities deemed to violate the Constitution or other national laws;

    6. Shall have the right to create special commissions;

    7. Shall exercise any other function assigned to them by the Constitution and law.

  • Article 58. Within the territorial limits of their authority, the Municipal Councils:

    1. Shall comply with and execute national laws;

    2. Shall approve and control the economic plan and budget of the Municipality;

    3. Shall organize the operation of entities responsible for carrying out economic, educational, health, cultural, sports, environmental protection and recreation activities, production and services subordinated to them;

    4. Shall revoke or modify all provisions from subordinated entities deemed to violate the Constitution or other national laws;

    5. Shall have the right to create special commissions;

    6. Shall exercise any other function assigned to them by the Constitution and law.

  • Article 59. The rights and duties of members of Provincial and Municipal Councils are set by law.

Chapter 7: On the Judiciary

  • Article 60. Justice is imparted in the name of the Aryaxian people by the Supreme Court and other courts instituted by law.

  • Article 61. Judges shall be independent and solely obey the law and the Constitution.

  • Article 62. The Supreme Court is empowered with the maximum judicial authority. Its resolutions are final and definitive.

  • Article 63. Definitive resolutions by the courts have to be obeyed without question by all citizens, economic entities and institutions and State organs.

  • Article 64. Preservation of legality and compliance with this Constitution and national laws by all people in the territory of the People’s Republic, its State organs and economic entitites shall be a fundamental duty of the Prosecutor's Office, which is accountable to the People’s Assembly.

  • Article 65. The Prosecutor General shall direct and regulate the activities of the Prosecutor's Office in all the national territory.

Enacted and obeyed by the Aryaxian people since the year 1959, last revised in the year 2021.

I checked the https://nsindex.net/wiki/World_Assembly_Category#Thresholds nation classification thresholds on NSIndex and I'm high on civil rights, economic rights and medium in political freedoms yet I'm still not getting the Capitalizt classification. Can anyone give me some advice?

    11. Shall appoint and remove the representatives of the State in foreign nations;

    12. Shall approve or reject the representatives of foreign nations in Aryax;

    13. Shall ratify or denounce international treaties;

    14. Shall exercise any other function assigned to the Cabinet by the Constitution and law.

  • Article 49. The National President:

    1. Represents the State and the Government and directs their general policies;

    2. Attends and controls the development of the activities of the Cabinet and other central institutions of the State;

    3. Presides over and directs the meetings of the Cabinet;

    4. Shall choose the members of the Cabinet, accept their voluntary resignations and decide their substitutions;

    5. Is the Supreme Commander of the Popular Army;

    6. Shall sign all decrees and other decisions adopted by the Cabinet;

    7. Shall exercise any other function assigned to the National President by the Constitution and law.

  • Article 50. In case of incapacitation, sickness or death of the National President, a previously chosen successor that is member of the Cabinet shall temporarily take over until the next election.

  • Article 51. The members of the Cabinet:

    1. Shall each direct their corresponding Ministry or Agency;

    2. Dictate, when it is not an express attribution of another organ of the State, the required regulations for the execution of laws and decrees that concern them;

    3. Shall attend and have a voice and a vote the meetings of the Cabinet, and submit to it the necessary decree proposals;

    4. Shall nominate the corresponding civil servants.

    5. Shall exercise any other function assigned to them by the Constitution and law.

  • Article 52. All citizens, state-owned enterprises and institutions shall give the Cabinet or the People's Assembly the necessary information to fulfill their duties.

Chapter 6: On Administrative Divisions

  • Article 53. The national territory of the People's Republic is administratively divided in provinces and municipalities.

  • Article 54. Municipalities shall have their own legal personality and are governed by the corresponding Municipal Council, appointed by the corresponding Mayor.

  • Article 55. Municipalities shall be grouped in provinces, which shall have their own legal personality and are governed by the corresponding Provincial Council, appointed by the corresponding Delegate.

  • Article 56. All Delegates shall be appointed by the Cabinet. All Mayors and Vice Delegates shall be appointed by the corresponding Delegates.

  • Article 57. Within the territorial limits of their authority, the Provincial Councils:

    1. Shall comply with and execute national laws;

    2. Shall approve and control the economic plan and budget of the Province;

    3. Shall organize the operation of entities responsible for carrying out economic, educational, health, cultural, sport, environmental protection and recreation activities, production and services subordinated to them;

    4. Shall maintain fiscal control over Municipalities;

    5. Shall revoke or modify all provisions from subordinated entities deemed to violate the Constitution or other national laws;

    6. Shall have the right to create special commissions;

    7. Shall exercise any other function assigned to them by the Constitution and law.

  • Article 58. Within the territorial limits of their authority, the Municipal Councils:

    1. Shall comply with and execute national laws;

    2. Shall approve and control the economic plan and budget of the Municipality;

    3. Shall organize the operation of entities responsible for carrying out economic, educational, health, cultural, sports, environmental protection and recreation activities, production and services subordinated to them;

    4. Shall revoke or modify all provisions from subordinated entities deemed to violate the Constitution or other national laws;

    5. Shall have the right to create special commissions;

    6. Shall exercise any other function assigned to them by the Constitution and law.

  • Article 59. The rights and duties of members of Provincial and Municipal Councils are set by law.

Chapter 7: On the Judiciary

  • Article 60. Justice is imparted in the name of the Aryaxian people by the Supreme Court and other courts instituted by law.

  • Article 61. Judges shall be independent and solely obey the law and the Constitution.

  • Article 62. The Supreme Court is empowered with the maximum judicial authority. Its resolutions are final and definitive.

  • Article 63. Definitive resolutions by the courts have to be obeyed without question by all citizens, economic entities and institutions and State organs.

  • Article 64. Preservation of legality and compliance with this Constitution and national laws by all people in the territory of the People’s Republic, its State organs and economic entitites shall be a fundamental duty of the Prosecutor's Office, which is accountable to the People’s Assembly.

  • Article 65. The Prosecutor General shall direct and regulate the activities of the Prosecutor's Office in all the national territory.

I’m curious why you chose to legally define marriage as heterosexual only. Is it to promote a higher birth rate? And I am also curious if homosexuals are given equal protection under the law and if the state mandates equal treatment

I find that curious in and of itself, if you really want to baby boom you shouldnt have marriages, at least in theory. One male can impregnate dozens of females.

OOC: This nation does not represent my political views and it is intended to be a brutal totalitarian state that denies any rights to its citizens, as can easily be checked from my NS stats and policies. The Constitution is largely inspired by that of Cuba, the USSR, and the DPRK (all of which oppose LGBT rights) among others, and already hints at broad discrimination against social groups: article 13 leaves sexual orientation and gender, article 14 does not actually guarantee gender equality at all and article 18 is a de facto ban on LGBT rights, justified on moral grounds. Aryax takes a genocidal attitude against the LGBT collective and religious believers, but IC it will never admit such atrocities.
