Draft: Legislative Aide Program
BE IT ENACTED BY THE TARKIN SENATE
PREAMBLE
Recognizing that the legislative workload of the Senate has grown in both volume and complexity; Affirming that the Republic is strengthened when members outside the Senate have a structured path into legislative work; Noting that informal arrangements between Senators and assisting nations have operated without uniform standards or recognition; Desiring to establish a clear and transparent framework for legislative assistance; The Senate hereby enacts the Legislative Aide Program Act.
ARTICLE I: DEFINITIONS
For the purposes of this Act:
(1) Legislative Aide means a nation appointed under this Act to assist a sitting Senator in the performance of legislative duties.
(2) Sponsoring Senator means the sitting Senator who appoints and directs a Legislative Aide.
(3) Speaker means the Speaker of the Tarkin Senate.
(4) Eligible Nation means a nation recognized as a Citizen Nation of the Republic of Tarkin, or a nation that has satisfied the residency requirement for citizenship but has not yet been certified by the Secretary of State.
(5) Certificate of Legislative Service means the formal record of completed service issued under Article VIII.
ARTICLE II: ESTABLISHMENT OF THE PROGRAM
(1) There is hereby established the Legislative Aide Program of the Tarkin Senate.
(2) Each sitting Senator may appoint one Legislative Aide, for a maximum of five Aides across the Senate at any time.
(3) Service as a Legislative Aide is voluntary and confers no office, salary, or standing within the Republic beyond that established by this Act.
ARTICLE III: ELIGIBILITY
(1) Any Eligible Nation may be appointed as a Legislative Aide.
(2) A nation appointed on the basis of pending eligibility shall be understood to hold the position in full, and the pending status of their certification shall not limit the duties they may perform under Article V.
(3) An Eligible Nation shall maintain that status for the duration of their service.
ARTICLE IV: APPOINTMENT AND TERM
(1) A Sponsoring Senator shall appoint a Legislative Aide by notice to the Speaker, who shall record the appointment in the Senate records.
(2) The notice of appointment shall state whether the appointee holds citizenship or is appointed on the basis of pending eligibility.
(3) An appointment runs concurrent with the term of the Sponsoring Senator and expires at the close of that term unless renewed.
(4) A Legislative Aide may resign at any time by notice to the Sponsoring Senator and the Speaker.
ARTICLE V: DUTIES AND LIMITATIONS
(1) A Legislative Aide may conduct research, prepare drafts and summaries, assist with correspondence, and perform recordkeeping at the direction of the Sponsoring Senator.
(2) A Legislative Aide holds no vote in the Senate, may not introduce legislation, and may not act on behalf of a Senator in any procedural or voting matter.
(3) Work product prepared by a Legislative Aide carries no legislative effect until formally introduced or adopted by a sitting Senator.
ARTICLE VI: ADMINISTRATION
(1) The Speaker shall administer the Program, maintain a current public roster of Legislative Aides, and record all appointments, resignations, and removals.
(2) The Speaker may issue procedural guidance for the Program provided such guidance is not inconsistent with this Act.
ARTICLE VII: REMOVAL AND VACANCY
(1) A Sponsoring Senator may remove their Legislative Aide at any time and without cause by notice to the Speaker.
(2) The Speaker may remove a Legislative Aide for conduct in violation of Senate rules, following notice to the Sponsoring Senator.
(3) Loss of citizenship under the Citizenship Act, or departure from the region by a nation appointed on the basis of pending eligibility, shall automatically vacate the appointment. The Speaker shall record the vacancy upon notice of the change in status.
(4) A vacancy may be filled by the Sponsoring Senator at any time, subject to the limit in Article II Section 2.
ARTICLE VIII: CERTIFICATE OF LEGISLATIVE SERVICE
(1) Upon completion of a full term of service, the Speaker shall issue a Certificate of Legislative Service to the departing Legislative Aide.
(2) A Legislative Aide who resigns in good standing after serving at least half a term may be issued a Certificate at the discretion of the Speaker, on recommendation of the Sponsoring Senator.
(3) All Certificates shall be recorded in the Senate records.
ARTICLE IX: SEVERABILITY
If any provision of this Act is found to be invalid or unconstitutional, such invalidity shall not affect the remaining provisions, which shall remain in full force and effect.
ARTICLE X: EFFECTIVE DATE
This Act shall take effect immediately upon passage and Signature of the President unless vetoed, in which case the Act shall be effective upon a vote to override the same in accordance with the Constitution.
