3rd Constitution of The Kingdom of Albastru
We, the citizens of Albastru, seeking to provide for a basic structure of governance, basic rights for the citizenry, and basic set of powers for the people of Albastru do ordain, and endorse this Constitution for the Kingdom of Albastru.
§I - There shall be Three Branches of the Government of Albastru.
§II - The first branch of government shall be the Executive Branch.
§IIa - This branch consists of the Monarch, the Prime Minister and the Ministers.
§III - The second branch of govenment shall be the Legislative Branch.
§IIIa - This branch consists of the unicameral body know as the Royal Council.
§IV - The third branch of government shall be the Judicial Branch.
§IVa - It consists of the Supreme Court of Albastru.
§V - This Constitution may be rendered null and void with a three fourths (3/4) majority in a referendum. A referendum on this may be called if a majority in favor is reached in the Royal Council.
§VI - This Constitution may be amended with a two thirds (2/3) majority in a referendum. A referendum on this may be called if a majority in favor is reached in the Royal Council.
§I - There shall be a head of state known as the Monarch of Albastru.
§II - The Monarch shall oversee External Affairs.
§IIa - This includes Foreign Affairs.
§IIb - This includes Defence Affairs.
§IIc - This includes Recruitment Affairs.
§IId - The Monarch may delegate some or all of these areas to The Royal Council of Albastru.
§III - The Monarch shall have a seat on the Royal Council.
§IV - The Monarch shall oversee Internal Affairs together with the Prime Minister.
§IVa - This includes Integration Affairs.
§IVb - This includes Cultural Affairs.
§IVc - This includes Roleplay Affairs.
§V - The Monarch shall appoint members of The Royal Council of Albastru based on the result of general elections.
§VI - The Monarch shall preside over all Elections in Albastru.
§VII - The Monarch may appoint the Chief Justice of The Royal Court without consenting Royal Council.
§VIII - The Monarch may not be appointed Prime Minister.
§IX - The Monarch may not be appointed Chief Justice.
§X - The Monarch may not stand in Associate Justice Elections.
§I - There shall be a successor to the Monarch known as the Prince(ess) of Albastru.
§II - The successor shall be selected by the Monarch.
§III - The successor may stand any election.
§IV - The successor may not be appointed Prime Minister.
§V - The successor may not be appointed Chief Justice.
§VI - The sucessor shall advice the Monarch, the Prime Minister, and the Royal Council.
§I - There shall be a unicameral Legaslative Body known as the Royal Council of Albastru.
§II - The Royal Council shall be made up of at least 4 members, not including The Monarch.
§III - Council Member tenures shall last Four Months.
§IV - The Royal Council shall be elected by the citizens of Albastru in general elections held every four months.
§IVa - Any citizen of Albastru that is present in the Discord server shall have the right to stand in Royal Council elections.
§V - The Royal Council shall have duties.
§Va - These duties shall include Voting on Legislation.
§Vb - These duties shall include Debating on Legislation.
§Vc - These duties shall include Proposing Legislation.
§VI - The Royal Council shall appoint a Prime Minister with a majority vote.
§VII - The Royal Council shall assist the Prime Minister and the Monarch with overseeing Internal Affairs.
§VIIa - This includes Integration Affairs.
§VIIb - This includes Cultural Affairs.
§VIIc - This includes Roleplay Affairs.
§VIII- The Royal Council shall, in the case of an unsolvable dispute between the Monarch and the Prime Minister, cast the deciding vote in said dispute.
§IX - Any councillor, subtracting the Monarch, should they choose to exercise this right, is liable to being relieved of their post by The Royal Council of Albastru.
§IXa - This can be done through a Three Fourths (3/4) vote of no confidence.
§IXb - The Royal Council may bring charges against the relieved councillor, if the motion receives a simple majority.
§IXc - If the motion to bring charges achieves majority, a trial shall then be held for the member with the Chief justice of the Royal Court of Albastru presiding.
§I - There shall be a head of government known as the Prime Minister of Albastru.
§II - The Prime Minister shall be appointed through a majority vote in the Royal Council.
§IIa - The Prime Minister has to be an incumbent Royal Councillor.
§III - The tenure of the Prime Minister shall last from their appointment until the next Royal Council Election.
§IV - The Prime Minister shall oversee Internal Affairs together with the Monarch.
§IVa - This includes Integration Affairs.
§IVb - This includes Cultural Affairs.
§IVc - This includes Roleplay Affairs.
§V - The Prime Minister may appoint ministers.
§Va - The Prime Minister may dismiss ministers.
§VI - The Prime Minister chairs the Royal Council.
§VII - The Prime Minister may be dismissed by the Royal Council if a motion of no confidence gathers a majority in the Royal Council.
§I - There shall be parts of the government known as ministries.
§II - Ministries may be created by the Royal Council through a majority vote.
§III - Ministries may be dismantled by the Royal Council through a two thirds (2/3) vote.
§IIIa - The Royal Council may not dismantle the Ministry of Foreign Affairs.
§IV - The ministries shall handle their respective areas by following the guidelines set out for the respective ministries.
§V - The ministries shall be led by a minister.
§VI - The ministers shall be appointed by the Prime Minister for an indefinite amount of time.
§VII - A minister may be dismissed by the Prime Minister at any time.
§I - The Judiciary shall be made up of a Chief Justice and at most four (4) other Associate Justices.
§II - The Royal Court shall be the leading and central Judiciary of the Region.
§III - The Royal Court shall have judicial review Powers extending to all cases that arise under this Constitution or Treaties made, or which shall be made, under their jurisdiction.
§IV - The Royal Court may create and follow its own procedures that it can determine for itself.
§V - The Royal Court Shall Chair Public Inquiries of State, Law, and Justice.
§VI - The Royal Court Shall Preside over Civil Trials of Albastru.
§VII - The Royal Court Shall Preside over Criminal Trials of Albastru.
§VIII - The Royal Court Shall have the ability to declare a law unconstitutional should a case be brought forth or public inquiry be made.
§IX - The Royal Court cannot instruct the expulsion of a government official from office unless this person is impeached by the Royal Council, and the case must be in regards to impeachment.
§I - The Chief Justice shall be appointed by the Monarch.
§II - The Chief Justice's tenure shall last indefinitely.
§III - The Chief Justice shall Chair the Royal Court.
§IV - The Chief Justice shall have all duties of an Associate Justice.
§I - Associate Justices tenures shall last a year.
§II - Associate Justices shall be elected by the citizens of Albastru in general elections held every year.
§IIa - Any citizen of Albastru that is present in the discord server shall have the right to stand in Associate Justice elections.
§III - Associate Justices shall decide on the outcome of trials through a majority vote.
§I - All persons are granted the right to equal justice under law.
§Ia - This includes the right to require that due process be followed in any and all judicial proceedings.
§Ib - This includes the right to a speedy and public hearing of all judicial concerns before the Royal Court, and the right to a hearing free from pre-existing prejudices.
§Ic - This includes the right to request and be granted legal counsel in all proceedings before the Royal Court.
§Id - This includes the right to a decision on judicial matters based solely on the evidence and the law presented.
§Ie - This includes the right to be informed as to the nature and cause of any civil or criminal accusations against them.
§If - This includes the right to confront and be confronted with the witnesses for and against them.
§Ig - This includes the right to protection from self-incrimination, including protection from being compelled to act as a witness against themselves.
§Ih - This includes the right to be secure in person and property in all civil and criminal trials unless due process is followed.
§Ii - This includes the right to be protected from being tried twice for the same offence, notwithstanding a second trial granted on appeal of conviction.
§Ij - This includes the right to be protected against all cruel and unusual punishments and remedies.
§Ik - This includes the right to absolute confidentiality of all discussion between a person and their legal counsel without a warrant or permission from the person in question.
§II - The citizens of and other persons within the Kingdom of Albastru are protected by this article of rights. Every provision of this Constitution and all laws shall pay due respect to these rights, notwithstanding any reasonable restrictions as determined by law.
§IIa - All persons are granted the right to express their opinions and thoughts.
§IIb - This freedom does not preclude reasonable restrictions upon speech which violates terms of any communications media used by the Kingdom of Albastru.
§IIc - All persons are granted the right to freely establish, follow, and/or practice any religion.
§IId - All persons are granted the right to free press.
§IIe - All persons are granted the right to life, and security of person.
§IIf - All persons are granted the right to equal protection of the laws, and equal protection from discrimination of any type.
§IIg - All persons are granted the right to be protected in totality from bills of attainder or ex post facto laws.
§III - All persons are granted the right to keep communications and other personal effects private from the government without a warrant being issued by the Royal Court.
§IV - All citizens are granted the right to participate in the democratic process, including all elections, referenda, etc., whether by voting in, standing for, or campaigning during an election.
§IVa - No law or policy may be introduced that unreasonably or unjustly restricts this right.
§V - The rights of persons enumerated in this article shall not preclude the existence of further rights and liberties granted to them.
§VI - The Monarch can, at any time, can revoke the rights of an individual citizen with three quarters (3/4) consent of The Royal Council of Albastru for the protection of the Kingdom.
§VIa - The individual citizen in question may request a trial where the Supreme Court decides if said individual is a threat to Albastru.
§I - The World Assembly Delegate shall be elected by the citizens of Albastru in general elections held every year.
§Ia - Any citizen of Albastru that is present in the discord server shall have the right to stand in World Assembly Delegate elections.
§II - The WA Delegate shall recommend the citizens of Albastru on how to vote in the WA General Assembly and Security Council.
§III - The WA Delegate shall handle other WA-related affairs.
§IV - The WA Delegate shall not wield any other power.
