2nd Charter of Communitas
The 2nd Charter of CommunitasPreamble
We, the sovereign nations of Communitas, to carry on the torch of Community and to recreate a safe, secure, and stable administration, do hereby enact this Charter; the Charter of Communitas, as the cornerstone document of the government of Communitas.We do this to create a clear set of guidelines on how the region shall be administered.
Article I : Bill of Rights
Any nation residing in Communitas is automatically considered a Communitas Member, hereby referred to as a Communitasian.
All Communitasians are guaranteed equal protection under the law, with the exception of fascism, racism, homophobia, transphobia, ableism, or other bigoted ideologies that may jeopardize the harmony of Communitas.
No Communitasian may be subjected to inquiry into their private affairs without reasonable suspicion of wrongdoing.
All Communitasians are guaranteed the freedom to hold and exercise their opinions and beliefs freely, with the exception of fascism, racism, homophobia, transphobia, ableism, or other bigoted ideologies.
All Communitasians are guaranteed the freedom to associate with whomever they choose, with the exception of fascists, racists, homophobes, transphobes, ableists, or any group adhering to bigoted ideologies.
Article II : Citizenship
A Communitasian whose nation is in the World Assembly, endorses the lawful World Assembly Delegate Participates in Regional activities and Events, such as the discord server, and is recognised as such by the Rainbow House government (primarily seen as verification in the Discord Server by a High Ranking Official), is a native citizen.
Communitasians with a World Assembly nation outside of Communitas may; with the disclosure of their World Assembly nation; a review by the Public Safety Officer, or another High Ranking Official acting in their stead; and a simple majority vote by the WA Delegate, General Secretary, Internal Affairs Secretary, External Affairs Secretary, and Public Safety Officer; be granted non-native citizenship. Citizens granted this exception must update the Rainbow House Government with any changes to their World Assembly membership or lose their citizenship.
Citizens whose nation has ceased to exist, has been banned by the Internal Affairs Secretary, the Public Safety Officer, a member of the Moderation Council or a High Ranking Official acting in their stead, or has otherwise lost regional residency status shall lose their citizenship.
Article III. Leadership
The General Secretary is the head of state of Communitas chiefly responsible for upholding the laws and integrity of Communitas.
The General Secretary is responsible for management of High Ranking Officials. They can appoint and dismiss both High Ranking Officials and other Officials other than those which are explicitly appointed under some other mechanism by this charter, create new Official roles or remove Official roles. The General Secretary may not allow any role which they appoint, enumerated within this Charter, to remain unfilled for an extended period of time.
The World Assembly Delegate is responsible for the management of regional security and defense. The World Assembly Delegate has supreme authority over endorsement limits, ejections and bans, regional password, and other such actions when they are directly relevant to regional security and public safety, and in all other cases must act in concert with the General Secretary.
Article IV. Secretaries
The Secretary for Internal Affairs has the powers and responsibilities of:
Ensuring that the RMB is kept to certain standards, as dictated by the RMB rules.
Running the Question of the Day (QotD) on the RMB.
Organising weekly and one-off events for the server.
Has the power to give users on Discord warnings.
Maintaining additional bodies to assist with the aforementioned responsibilities.
The Secretary for External Affairs has the powers and responsibilities of:
Maintaining diplomatic ties & communicating with, and promoting Communitas to, any and all foreign regions.
Negotiating relations with current and potential future bilateral allies and inter-regional alliance structures.
Writing and negotiating treaties with foreign regions.
Maintaining a presence within the World Assembly Forums, to further our regional interests on a larger stage.
Aiding the WA Delegate and PSO in developing regional R/D policy.
Regulating embassies with different regions, both inside and outside of inter-regional alliance structures.
Taking responsibility for the duties of the Public Safety Officer when they are unavailable.
Or fulfilling their roles if the PSO position is currently unfilled.
The Cartographer is given the powers and responsibilities of:
Maintaining the map.
Creating new maps to expand on the world-building of Communitas.
All High Ranking Officials are expected to both contribute to and maintain Communitas roleplay events.
A High Ranking Official under the General Secretary may be removed if they fail to complete their duties.
Article V. Public Safety Officer
The Public Safety Officer has the powers and responsibilities of:
Assisting the World Assembly Delegate in their duties of regional defence.
Assisting the Secretary for Internal Affairs in ensuring the rules of the Regional Discord Server and RMB are upheld.
Ensuring that the region is kept safe from raiders, unlawful government coups, and any/all other external or internal threats.
Expelling nations which threaten regional security, such as by usurping the lawful World Assembly Delegate.
Enforcing any World Assembly Endorsement Cap, as well as any other policies intended to maintain the security of the lawful World Assembly Delegates tenure.
Running the military of Communitas, should we ever form one; including maintaining ultimate operational authority during military actions.
The Public Safety Officer is appointed by, and serves at, the joint discretion of the General Secretary and the World Assembly Delegate.
Article VI. Embassy Policy
The process for creating an embassy is prescribed as:
Sending a telegram to the External Affairs Secretary, with their region name and the reason they wish to open an embassy.
High Ranking Officials will hold a vote for it within 24 hours.
The vote required to create an embassy will be simple majority of the High Ranking Officials, with approval coming from at least one of either the WA delegate or the General Secretary in support, or from the Secretary for External Affairs.
Region must have the following tags:
Anti-Fascist
LGBT
Regions with the following tags are looked on more favourably:
Feminist
Socialist
Communist
Egalitarian
Regions must not have the following tags:
Fascist
Regions with the following tags are looked on less favourably:
Conservative
Anti-communist
Regions must not have the following second order tags (I.e., They must not have embassies with any regions which have the following tag):
Fascist
Regions must be in good standing with the international community generally, and with regions which Communitas is allied with especially.
Regions must not promote or permit a homophobic, transphobic, sexist, racist, or generally malicious/hateful community or atmosphere.
Regions considered to be embassy collecting, or which serve as puppet storage shall not be permitted embassies with us, unless granted a special exemption by the government of Communitas, typically due to being founded by a member of the government.
We explicitly encourage small regions which are just starting out to form embassies with us, provided they fulfill the above conditions! We don't bite, and are always happy to help out people just starting out in NationStates!
To this end, we do not demand that regions are a minimum size to apply for an embassy.
The government of Communitas reserves the right to close embassies with any region which, after having opened an embassy with Communitas, changes in nature or character in a way that it no longer meets the requirements laid out within this document.
Article VII. Amendments
The High ranking officials may amend this charter with a two thirds majority “In favor” vote.
If three of the World Assembly Delegate, the General Secretary, the Internal Affairs Secretary and External Affairs Secretary vote against the amendment, the amendment will fail, irrespective of reaching the required two-thirds majority required.
The General Secretary, the World Assembly delegate, and one other High ranking official, together, can make an amendment to this charter that ends in 14 days, or when two other high ranking officials are “in favor” of ending it before the 14 days.
This ability can be temporarily suspended if three High Ranking officials are “in favor” of suspending it. A vote must be held no later than every 7 days, and the suspension will end if the number of high ranking officials “in favor” are less than 3 or after 30 days.
The amendment powers bestowed under Article VIII, Clause 1.b cannot amend any clause in Article VIII.
Article VIII. Voting in Rainbow House
Defines a High Ranking Official as an Official role which bestows the holder with voting rights within Rainbow House.
The High Ranking Official roles are:
General Secretary
World Assembly Delegate
Public Safety Officer
Internal Affairs Secretary
External Affairs Secretary
Cartographer
Head Ambassador
No person may hold more than one of the following roles at the same time:
General Secretary
World Assembly Delegate
Internal Affairs Secretary
External Affairs Secretary
No person with any of the following roles: General Secretary, World Assembly Delegate, Internal Affairs Secretary, External Affairs Secretary; may hold the role of Assistant Internal Affairs Secretary or Assistant External Affairs Secretary.
This article shall not be amended under the power of Article VIII, Clause 1.b.
When a High Ranking Official needs to bring a matter to vote they shall:
Create a poll in the #votes channel.
Ping the @High Ranking Officials role in the #votes channel.
Pin the vote, for its duration, in the #votes channel.
Unpin the vote from the channel once a result has been reached.
When conducting a vote within the Rainbow House Government, each person may vote only once; regardless of if they hold multiple High Ranking Official roles - e.g., being both Assistant Secretary for Internal and External Affairs. The only exception to this is:
If an HRO is going to be absent from the server for an extended period of time, they may appoint a proxy from the rest of Rainbow House to vote on their behalf. The nominated proxy's vote shall then be counted an additional time.
It is strongly recommended that, absent a pressing countervailing reason, votes conducted before the House should last a minimum of 24 hours, and are encouraged to last 72 hours; unless an absolute majority is found before the House sooner.
- Emergency votes; for especially time critical affairs may be held for periods shorter than 24 hours, and are more likely to be ended early if an absolute majority is found before the House before the vote officially elapses.
It is further recommended, that for votes which, in the assessment of High Ranking Officials, do not need to be rapid should not be concluded early even if an absolute majority is found before the House; allowing ample opportunity for all High Ranking Officials to present their opinions, and any potential issues with the motion.
For matters which limit the sovereignty of our region, such as interregional treaties, or any other matter considered core governmental policy by the World Assembly Delegate, General Secretary, Internal Affairs Secretary or External Affairs Secretary; instead of holding a vote before the entirety of RH, a vote may be held between the World Assembly Delegate, General Secretary, Internal Affairs Secretary, and External Affairs Secretary.
Article IX. Governmental Emergencies
In response to an extreme occurrence, outside of normal governmental procedure, any High Ranking Official may declare a State of Governmental Emergency. During which the following powers are conferred on High Ranking Officials:
The power to banject any nation which threatens the safety or stability of the region.
The power to deputise long-standing native citizens with border control powers in order to banject nations which threaten the safety and stability of the region.
The power to make public statements and conduct talks with foreign regions without bringing a vote before Rainbow House.
Any other powers deemed necessary under the exigencies of the emergency.
The emergency powers bestowed by Article X, Clause 1 should, if at all possible, be executed whilst in an emergency government meeting, with the support of a majority of High Ranking Officials present.
A majority vote of the WA Delegate, General Secretary, Secretary for Internal Affairs, and Secretary for External Affairs may:
Strip a given High Ranking Official of their emergency powers.
End the State of Governmental Emergency.
Article X. Impeachment
Expulsion and Impeachment procedure for the WA delegate and the General Secretary:
Expulsion, or “getting expelled” is the removal from government with the possibility to return, while impeachment, or “getting impeached” is the removal from government without the possibility to return.
A vote to remove the General Secretary or the WA Delegate can be started by a motion to invoke this section by either 2/3 of the GenSec/WA Delegate (excluding whichever is having a vote held against them for their removal from government) and the EA Sec & IA Sec, or a petition from 10 nations which have been native, verified citizens of the server for at least 30 days.
After there is an attempt to commence Impeachment or Expulsion movements by the creation of a vote of the Top 4 (excluding the person facing removal) or a petition is made available for public signature, it is unlawful for the WA Delegate or the General Secretary to dismiss any High Ranking Officials until process is concluded or unless the decision to remove them is backed by a simple majority vote. In order to be eligible to vote on this matter, a person must hold one of the following roles: GenSec, WAD, EA Sec, IA Sec, PSO, Assistant EA Sec, Assistant IA Sec. Holding more than one of these roles does not grant additional votes.
Additionally, such a person who is under vote of expulsion or impeachment may not initialise the vote while their expulsion or impeachment proceedings are underway. However, until the proceedings are concluded, the person under impeachment proceedings still may use their right to vote, where their right would typically extend.
Native, verified citizens who have been native, verified citizens for at least 30 days, except the nation whose removal from government is being voted upon, shall have the right to vote on removing a nation from government.
Nations which had not more than 14 days ago been native, verified citizens, for at least 30 days, and which are still Communitas Members, may also vote in motion for removal from government. The vote to remove a nation from government shall take place under the following procedure:
In the first round, all candidates will be on the ballot. This vote must be held within 7 days of the impeachment, expulsion, or resignation of the previous General Secretary.
In the second round, the two candidates with the most votes in the first round shall be put on the ballot. The candidate with the most votes in this second round shall become the General Secretary, with the rules and responsibilities of said role. This vote must be held within 14 days of the impeachment, expulsion, or resignation of the previous General Secretary.
If there is no lawful WA delegate, then the rest of the High Ranking officials must appoint the specified number of candidates.
If the General Secretary resigns, and impeachment and/or expulsion procedures are not implemented within 24 hours of the resignation, the General Secretary will be deemed to have left “in good graces”, and shall be afforded the right to select one of the three to four candidates to be placed onto the ballot for the General Secretary election, with the procedures outlined in clause d and subclauses i and ii used within the same timeframes.
After the impeachment, expulsion, or resignation of the WA Delegate, the General Secretary shall appoint an “interm de facto WA Delegate” that shall represent the region, as the WA delegate. The WA Delegate must vote in accordance with the wishes of the “interm de facto WA Delegate” and must act in accordance with the wishes of the “interm de facto WA Delegate”.
Within 7 days, the General Secretary shall nominate no less than 3 and no more than 4 candidates for the position of the Lawful WA Delegate. The candidate with the most votes in an election open to all native citizens shall become the lawful WA delegate, with the rules and responsibilities of said role.
Within 14 days of the election, every registered native citizen shall remove their endorsement from the expelled, impeached, or resigned WA Delegate and shall endorse the Lawful WA Delegate, with the possibility of ejection without ban from Communitas of native citizens who do not comply.
If the WA Delegate refuses to give up the delegacy, they are then declared a “tyrant” and it becomes the duty of every Communitas member to work to depose the unlawful WA Delegate
If there is no General Secretary, the High Ranking Officials shall appoint the “Interm de facto WA Delegate” and the 2 candidates.
After the impeachment, expulsion, or resignation of the WA Delegate, the General Secretary shall appoint an “interm de facto WA Delegate” that shall represent the region, as the WA delegate. The WA Delegate must vote in accordance with the wishes of the “interm de facto WA Delegate” and must act in accordance with the wishes of the “interm de facto WA Delegate”.
Within 7 days, the General Secretary shall nominate no less than 3 and no more than 4 candidates for the position of the Lawful WA Delegate. If there is no General Secretary, the High Ranking Officials shall appoint the “Interm de facto WA Delegate” and the 2 candidates.
If the World assembly Delegate or General Secretary stops a lawful attempt at impeachment or expulsion, then they can be declared a “tyrant”, and it becomes the duty of every Communitas member to work to depose the unlawful WA Delegate or General Secretary.
A vote may be started by a petition of 10 native citizens of communitas who have been verified for 30 days to remove the impeachment of an impeached nation, returning them to being eligible for government positions. This vote requires eighty percent support from all voting native citizens to succeed.
This article shall be exempt from Amendment under Article VIII, Clause 1.b
Impeachment or Expulsion of other government officials:
A vote to remove any government officials save for the General Secretary or WA Delegate may be started by a petition of 10 native citizens of communitas who have been verified for at least 30 days.
Native, verified citizens who have been native, verified citizens for at least 30 days, except the nation whose removal from government is being voted upon, shall have the right to vote on removing a nation from government. Nations which had previously been native, verified citizens, for at least 30 days, not more than 14 days ago, and which are still Communitas Members, may also vote in motion for removal from government. The vote to remove a nation from government shall take place under the following procedure:
The first round of voting shall be for expulsion. Sixty percent of the votes cast must be “In Favour” of the expulsion to expel the target nation from the government. Voting on this shall last 72 hours.
Additionally, such a person who is under vote of expulsion or impeachment may not initialise the vote while their expulsion or impeachment proceedings are underway. However, until the proceedings are concluded, the person under impeachment proceedings still may use their right to vote, where their right would typically extend.
If the vote for expulsion passes, a further vote on impeachment shall be held. If eighty percent of votes cast are “In Favour” of expulsion, the target nation is expelled from the government. Voting on this shall last 72 hours.
If this vote is passed it becomes the duty of the General Secretary to appoint a replacement to fill the vacant role with the greatest possible haste. The General Secretary may not appoint the expelled nation back to the role from which they were expelled.
A vote may be started by a petition of 10 native citizens of communitas who have been verified for 30 days to remove the impeachment of an impeached nation, returning them to being eligible for government positions. This vote requires eighty percent support from all voting native citizens to succeed.
This article shall be exempt from amendment under Article VIII, Clause 1.b.
If any high ranking official gets a major warning, including if they get three minor warnings, they are expelled from government, but may return after an election, if they are the General Secretary or the World Assembly Delegate, or after 30 days, if it is another high ranking official.
If the General Secretary of the World Assembly Delegate prevents a High Ranking Official from performing their Duties according to the charter, or obstructs a vote by the High Ranking Officials, then they may be declared a tyrant and they are officially impeached.
