Criminal Offence Act - Rework

1. A nation shall immediately be suspended from all governmental positions pending review if credible evidence is raised to suggest that they are guilty of any of the following offences defined in this Act

1a. A nation will be issued a banjection of length deemed suitable by the Supreme Court and/or immediate ejection and temporary or permanent bans from all positions if they are found by an official investigation, trial, or other government review to have committed any of the offences defined in this Act

2 - Bribery

2a. Acceptance of a bribe or inducement that has the intention of influencing a party in the Supreme Court to testify false information. Unless stated otherwise, for the purposes of this and following legislation, bribe and bribery is defined as the offering, promising, giving, accepting or soliciting of an advantage as an inducement for an action which is illegal, unethical or a breach of trust, and with malicious intent

2b. Bribery or inducement of a member of government, with the intention of influencing a government decision or action

2c. Bribery or inducement of a witness or party in the Supreme Court to testify false information

2d. Acceptance of a bribe or inducement that has the intention of influencing a government decision or action

3 - Falsification of documents

3a. Creation of false official government documents, with malicious intent. Unless stated otherwise, for the purposes of this and following legislation, malicious intent is defined as acting wilfully or intentionally to cause harm, without legal justification

3b. Destruction of government documentation or information, with malicious intent

4 - Unauthorised disclosure of confidential information

4a. Disclosure of confidential government communications or classified information, with malicious intent

5 - Fraud

5a. False impersonation of a member of the region, with malicious intent

5b. False representation as a member of government, with malicious intent

6 - Obstruction of legal process and government business

6a. Obstruction of a Supreme Court order, with malicious intent, where Obstruction is, Unless stated otherwise, for the purposes of this and following legislation, obstruction is defined as “preventing the normal function”,

6b. Obstruction of a Supreme Court investigation, with malicious intent, including deliberate withholding of information pursuivant to an ongoing investigation, by the furnishing of false information, or perverting the proper course of an investigation

6c. Obstruction of a Supreme Court trial, with malicious intent, including deliberate withholding of information pursuivant to an ongoing trial, including by the furnishing of false information, or perverting the proper course of a trial

6d. Obstruction of the normal running of The Leftist Assembly, including deliberate withholding of information pursuivant to any breach of the legal code of The Leftist Assembly

6e. Obstruction of the function of any regional or personal communications

7 - Offensive actions

7a. Slander, libel, or blackmail against any nation

7b. Slander, libel, or blackmail against any region

7c. Slander, libel, or blackmail against any individual

7d. Posting discriminatory content on the basis of gender, sexuality, ethnicity, disability, socioeconomic status or any other oppressive attitudes with malicious intent

7e. Participation in the invasion of an embassy region

7f. Support for a far right-wing ideology with malicious intent

8 - Treason

8a. Treason, defined as the illegitimate overthrowal of a lawfully-appointed government, or seditious conspiracy to do so

or

8b. Treason, defined as the illegitimate overthrowal of a lawfully-elected government, or seditious conspiracy to do so

9 - Abuse of power

9a. Abuse, or repeated abuse, of lawfully-granted regional authority abilities, with malicious intent

9b. Ejection of a nation in good-standing from the region, without just cause, and with malicious intent

9c. Neglect of the responsibilities of a government position, with malicious intent

9d. Removing the Founder nation from the region, with malicious intent

9e. Use of a government position to advance the aims of a foreign government or organisation, with malicious intent

10 - Other

10a. Breach of any other law or legislation laid out within the legal code of The Leftist Assembly

11 - Emergency powers

11a. If a banjection is believed to be urgently required or has been ordered by the Chief Justice as a result of contempt of court, the Court, Chief Justice, or Secretary may issue a special order

11b. Any nation with Border Control authority may immediately execute the removal, or “banjection” of a nation with a special order passed against it

12 - Appeals

12a. A member nation or affected party may appeal to lift a banjection if any one of the following criteria are fulfilled

12b. The time elapsed has been no less than six months

12c. The Supreme Court has ordered an earlier review

12d. The banjection was not court-ruled, and has not since been formally contested.
