Constitution of the Republic of Nova Libertatia

We the People of Nova Libertatia, to ensure security, peace, and justice, preserve our liberty from tyrants, and defend this nation from foreign and internal threats, establish this Constitution for Nova Libertatia.

Article 1.

Section 1.
Congress shall serve as the national legislature, and be divided into two chambers, the Assembly and the Senate.
Section 2.
Members of the Assembly shall be elected every three years by the people of the Congressional district which they represent. They must be residents of the states which they represent, must be at least twenty-five years old, and must have been citizens of this Nation for at least ten years. Representatives shall be assigned to states according to their population. One Representative shall represent no more than fifty thousand people. If vacancies occur in the Assembly, the President or acting President shall fill these seats by Writs of Election. The President of the Assembly shall be elected by a majority vote of its members. Should all candidates be unable to obtain a majority vote, he with the most votes shall be President.
Section 3.
Members of the Senate shall be elected by the inhabitants of the states which they represent to a term of six years. The Senate shall be divided into two Classes. The First Class refers to Senators whose terms will end in three years or less, while the Second Class refers to Senators whose term will end in six to three years. They must be residents of the states which they represent, must be at least twenty-five years old, and must have been citizens of this Nation for at least ten years. Each State shall have two Senators. The President of the Senate shall be elected by a majority vote of its members; if no candidates obtain a majority, he with the most votes shall be President.
Section 4.
Congress must assemble at least once every year, at a specific date, set by the Presidents of both Chambers, or, if they disagree on the date, the President of Nova Libertatia. Each Chamber may set its own punishments for disorderly behavior. Each Chamber shall keep an official Journal of legislative proceedings, including the votes or abstainments of each member, and each year publish it. Parts may be redacted should they relate to a matter that requires secrecy. Unless the other Chamber consents, no Chamber shall adjourn for more than three days.
Section 5.
Members of Congress shall receive compensation for their services from the national Treasury. They shall be safe from arrest while attending Sessions of their Chamber and when going to or returning from them, except in cases of treason or felony. Congressmen may not hold any other public office during their term in Congress.
Section 6.
Bills which pass both Chambers of Congress shall be delivered to the President of Nova Libertatia. If he signs it, the bill shall become a law, but if he disapproves of it he may veto it and return it to the Chamber where it originated. If two-thirds of that Chamber votes for the bill, the presidential veto shall be overridden and the bill shall become law. No bill introduced to Congress may violate this Constitution. Such bills shall be null and void.
Section 7.
Congress shall have the power to collect taxes, tariffs, and import duties for the general welfare, but only for the general welfare of the nation and not for private interests; it shall not have unrestricted power of taxation, and it shall never establish a sales tax on essential items or an income tax. No bill of amendment may repeal this clause.
Congress may borrow money for the government, but the national debt must not exceed one billion Denarii or Congress will be forbidden from borrowing money until the debt is repaid. No bill or amendment may repeal this clause.
Congress may regulate trade with foreign nations and establish rules for immigration and naturalization.
Congress may print money, permanently backed by the gold standard, which may never be repealed by any law or amendment, as well as establish laws on bankruptcy, and establish punishments for counterfeiting.
Congress may establish post offices.
Congress may grant inventors patents on their creations.
Congress may establish courts lower than the Supreme Court.
Congress may punish offenses on the high seas.
Congress may declare war and sign treaties; no treaty may violate this Constitution, and any signature on such a treaty or ratification thereof on behalf on Nova Libertatia shall be null and void.
Congress may raise armies and support the Armed Forces, but it may not impose conscription. This clause may not be repealed by any law or amendment.
Congress may make laws necessary for executing the aforementioned powers and responsibilities.
Section 8.
Congress may not prohibit immigration to or from Nova Libertatia.
No public official of local, state, or federal governments may suspend the Right of Habeas Corpus. This clause may not be repealed by any bill or amendment.
Congress may not pass Bills of Attainder.
Congress may not tax commerce within Nova Libertatia.
Congress may not tax exports from Nova Libertatia.
Congress may not establish any State as superior or inferior to the other States.
Congress may not draw money from the Treasury without releasing a full report of expenditures to the public.
Congress may not grant Titles of Nobility, neither shall any holder of a state or federal public office within Nova Libertatia accept a foreign title of nobility, public office, or award, without the consent of Congress.

Article 2.

Section 1.
The executive office shall be that of the President of Nova Libertatia. He shall serve a term of four years. Presidential candidates must have been born in Nova Libertatia, must have lived in Nova Libertatia for at least fifteen years, and must be at least thirty years old. No president may serve for more than two terms. Vice Presidential candidates shall be appointed by their corresponding presidential candidates, or running mates. The Vice President shall become President of Nova Libertatia if the President has died or been permanently incapacitated, and acting President if the President is temporarily incapacitated. If the Vice President is also dead or incapacitated, the officials in the following line of succession may serve as acting President: President of the Assembly, President of the Senate, and Cabinet members in the order in which their departments were created, from oldest to newest. These officials, however, may not hold the title of President despite being acting President.
Section 2.
The President shall be elected by an Electoral College. The People of a State shall vote for their preferred presidential candidate, and the candidate who gains a majority vote in that state gains all electoral votes from the state. The number of a state's electoral votes shall be equal to the amount of Senators and Representatives it possesses in Congress. The candidate with the most electoral votes shall become President. Election Day shall be chosen by Congress and shall be the same throughout all of Nova Libertatia. He shall are office in an Inauguration ceremony on a set day, which shall be chosen by Congress but must be within the month of January. During his Inauguration, he must take the following Oath or Affirmation:
"I solemnly swear that I shall faithfully serve as President of Nova Libertatia, and will to the best of my ability, preserve, protect, and defend the Constitution of Nova Libertatia and the Liberty of the People of Nova Libertatia.
Section 3.
The President shall receive compensation for his services at that time from the Treasury. He may not receive any other salary from the Federal Government until his presidency ends.
Section 4.
The President shall be Commander in Chief of the Armed Forces of Nova Libertatia, and he shall have power to grant Pardon for crimes committed against Nova Libertatia, except for those who were impeached and convicted.
Section 5.
The President shall deliver a speech regarding the State of the Republic to Congress every year, shall receive foreign ambassadors, and shall appoint officers to Departments of the Executive.
Section 6.
The President may be Impeached for Treason, Bribery, Felony, or other high crimes. The Assembly may Impeach the President for a crime by a two-thirds majority vote, while the Senate may convict the President and remove him from office by a two-thirds majority vote. Removal from office by Impeachment shall disqualify one from holding all forms of public office. No other punishment shall occur from Impeachment.

Article 3.

Section 1.
Judicial powers shall be held by one Supreme Court of Nova Libertatia, and lesser courts which may be established by Congress. The Judges shall receive compensation for their services from the national Treasury at a specified time.
Judicial power shall extend to all legal proceedings, except those with a foreign nation or citizens of a foreign nation. Trials must be held within the State where the crime was committed. If the crime was not committed in any State, the trial may occur in places set by Congress.
Section 2.
Treason against Nova Libertatia shall refer to making war against it or aiding its enemies. No one may be convicted of Treason without the testimony of two witnesses to the act or confession in court. Congress shall determine the punishment for Treason, but Forfeiture may not be imposed except during the life of the person convicted.

Article 4.

Section 1.
States must fully recognize the records and acts of all other States. Residents of each States shall enjoy the same Rights and Privileges in all other States. Fugitives who flee from the State where their trial is to be held shall be returned to the aforementioned State to stand trial. New States may be added to the Republic, but States may not be formed out of existing States or regions of States without the consent of the State Legislature and Congress. Congress may produce legislation regarding territories of the Republic that are not part of any state.
Section 2. A State may Secede from the Republic only if three-fourths of the State Legislature, three-fourths of the State's Population, the State Governor, and two-thirds of both Chambers of Congress consent. Any other form of Secession is illegal and states which attempt to secede illegally may be forcibly reincorporated into the Republic.

Article 5.
The following Rights are guaranteed to all Citizens of Nova Libertatia. No Bill may infringe on them and no Amendment may repeal them. Any Bill or Amendment which attempts to do so shall be null and void.

The Government may not infringe on Freedom of Religion. No authority may establish a state religion or state atheism, and no authority may forbid the exercise of religion or of atheism.
The Government may not infringe of Freedom of Speech, the Freedom of the Press, or the Right to Protest grievances.
The Government may not infringe on the Right to Bear Arms or concealed carrying of arms in public.
The Government may not search or seize any property without a Warrant of probable cause.
The Government may not take property for public use without just compensation, and it may not abuse eminent domain for frivolous or unnecessary purposes.
The Government may not force Citizens to quarter soldiers in their homes or on their property.
All trials for crimes except Impeachment must be held by jury.
No Rights may be denied on the basis of race, gender, ancestry, or ethnicity.
No slavery shall exist in Nova Libertatia.
The Right to vote shall not be denied to any citizen 18 years of age or older.
Conscription may not be imposed.
All Citizens, Nationals, and Residents are guaranteed the Right to Life unless convicted of a capital offense. No abortions shall be conducted in Nova Libertatia, and no institution may be created for providing abortions.
The enumeration of rights in this Constitution shall not be construed as denying other rights retained by the people.

Article 6.

This Constitution shall be the supreme law of the land; no bill or act may violate it. A bill that does so shall be null and void. All public officials must take an Oath or Affirmation to support this Constitution, but no religious test may be required for any public office. With the concurrence of two-thirds of both chambers of Congress or two-thirds of the States, Congress may call a Convention for proposing Amendments to this Constitution, which shall be added to this Constitution upon ratification by three-fourths of the States.

Article 7.

The Ratification of this Constitution by three-fourths of the States shall be sufficient for the Establishment of this Constitution, however, it shall only take effect in the States that have ratified it. When all States have ratified this Constitution, new States wishing to join the Republic must also ratify this Constitution to be admitted.
