The Constitution of the Empire of the Levellers.

PREAMBLE
The Levellers stands to preserve democracy under the Emperor, freedom of speech, and the right to live free from tyranny. We will always stand to preserve these rights, no matter what the cost may be, we will welcome all who wish to join no matter what their past maybe for the problems of their past is theirs but the problems of their future are our privilege. We shall not judge anyone based on race, creed or sexuality. This constitution will forever stand as a reminder of all the laws that belong to the Levellers.

CHAPTER ONE - BASIC RIGHTS

    ARTICLE ONE - CITIZENSHIP

    This charter defines a nation as a citizen of the Levellers if at least one of the following is true:

      1. Is a native.
      2. Is a founder member of the region.
      3. Is a nation that was recruited by a citizen of the Levellers.
      4. Is a nation that was given honorary citizenship by the Emperor or parliamentary decree.

    The status of citizen of the Levellers is revoked if at least one of the following is true:

      1. Is not a native.
      2. Is a nation accused and found guilty of, a MAJOR crime against the region. (Spying, treason, etc.)
      3. Is a nation that has lost the status of honorary citizen.

    ARTICLE TWO - CIVIL RIGHTS

    We hold all the rights below to be forever true, and the Levellers demands of all its citizens that they will stand to preserve all the rights that are found below.

      1. All nations have the right to become citizens of the Levellers.
      2. All citizens of the Levellers hold the right to define their form of government without fear.
      3. All citizens of the Levellers hold the right to equality.
      4. All citizens of the Levellers hold the right to safety and protection.
      5. All citizens of the Levellers hold the right to participate in RP.

    ARTICLE THREE - POLITICAL RIGHTS

      1. All citizens hold the right to a free Constitutional Monarchy.
      2. All citizens hold the right to a free Democracy under the Emperor.
      3. All citizens of the Levellers hold the right to unlimited freedom of speech.
      4. All citizens of the Levellers hold the right to create and administrate a political party regardless of their ideology.
      5. All citizens of the Levellers hold the right to join a political party.
      6. All citizens of the Levellers hold the right to run for an office regardless of their political ideology.
      7. All citizens of the Levellers hold the right to question their government.
      8. All citizens of the Levellers hold the right to hold any referendum of their government, needing a two-thirds majority to pass.

    ARTICLE FOUR - LEGAL RIGHTS

      1. All citizens hold the right to a fair trial.
      2. All citizens of the Levellers hold the right to name a legal assessor for their defense if they are being accused of a crime.
      3. All citizens of the Levellers hold the right to a last regional poll to name their sentence.

CHAPTER TWO - GOVERNMENT STRUCTURE

    ARTICLE ONE - CENTRAL GOVERNMENT AND PARLIMENT

    The central government of the Levellers is formed by the Emperor, and an Elected Chancellor. The Parliament will be formed by 5 Members of the Parliament

    ARTICLE TWO - POWERS AND RESPONSIBILITIES OF THE EMPEROR

      1. The Emperor of the Levellers is the Head of the region, his duty is to represent the interests of the region, and to sign off on the proposals of the Chancellor to the parliament, and to review all bills that are brought before him by the chancellor or by an MP.
      2. The Emperor exercises the right to enact executive orders, that may only be vetoed if all the Parliament, all the judiciary, or two-thirds of the citizenry agree to veto it.
      3. The Emperor is subject to a set of executive order laws, known as the Imperatoris Edictum*, that are specific to the Emperor alone.
      4. If the Emperor abdicates or is removed from office by a two-thirds majority of the citizenry vote in favor of removal in a referendum, then the position immediately is passed to the founder.
      5. The position of Emperor is not subject to elections.
      6. The Emperor holds all admin powers.

    ARTICLE THREE - POWERS AND RESPONSIBILITIES OF THE CHANCELLOR

      1. The Chancellor of the Levellers is the elected secondary leader of the region, his main duty is to represent the interests and preoccupations of the citizens and send proposals to the parliament.
      2. The Chancellor excises the right to enact executive orders**, that may only be vetoed if all the parliament, or the Emperor agree to veto it.
      3. The Chancellor is the head of the executive branch and as such has the final say on a divided poll, however, if the Judiciary and the parliament agree, or the Emperor decrees it, they can override the decisions of the Chancellor.
      4. The Chancellor is subject to elections every 4 months with the possibility of being reelected once, a former Chancellor needs to wait for another four mandates to run again for any office.
      5. If the Chancellor resigns or gets expelled from his office, the Emperor will take up the duties of Chancellor, and elections for this position must be carried out immediately.
      6. The Chancellor holds all admin powers.

    ARTICLE FOUR - POWERS AND RESPONSIBILITIES OF THE PARLIAMENT

      1. The Members of the Parliament are elected representatives of the region, his main duty is to pass laws that have importance for the citizens.
      2. With any majority they can pass a new law,
      3. The members of the parliament powers are as follows: Border control, polls, communications and appearance
      4. MPs are subject to re-election every 3 months and can be re-elected indefinitely.
      5. If an MP resigns or gets expelled from his office, the Chancellor or Emperor may name an interim MP and elections for this position must be carried out immediately.
      6. If any nation is trying to undo or undermine the principles of our democracy, they shall be spited as the parliament deems fit. (THIS POINT WILL ONLY BE APPLIED IN CASES OF INTERNAL SECURITY)

    ARTICLE FIVE - POWERS AND RESPONSIBILITIES OF THE WA DELEGATE

      1. The WA Delegate is the only official diplomatic officer of the Levellers, his main duty is to represent the state in the WA and other regions.
      2. The WA Delegate is subject to elections every 5 months and can be re-elected twice.
      3. In order to run for the office of WA Delegate the nation has to be part of the WA, if WA Delegate resigns or gets expelled from the WA, elections for this position has to be carried out immediately.
      4. The WA delegate will hold poll and embassy powers.
      5. The WA delegate may appoint a diplomatic officer to act as their assistant. (said officer would possess border control and embassy powers)

    ARTICLE SIX - ROLE OF PARTIES

    It is important to remember you are voting for a person, not a party. An elected official can leave their party at any time; however, this is not to say that the party they've left can't respond by calling an election or barring them from the party.
    The political parties in the region have the mission of:

      1. Ensuring their membership are citizens of the Levellers.
      2. Ensuring the protection of their rights.
      3. Engaging in dialogue with other parties to foment a peaceful democracy.
      4. Informing their view of state administration.

CHAPTER THREE - INTERNAL SECURITY

    ARTICLE ONE - SECURITY AND PUNISHMENT

    WAR DECLARATIONS: The Levellers must always be secure, no matter the cost. In the case a region has become hostile the Emperor and the government may consider a military response, which needs to be ratified by the parliament and then the citizens by a poll, in the case that the region is being invaded, the Emperor will be free to exercise special powers, however, both Emperor and parliament may reach an agreement on which his powers will be, if consensus is not reached within 6 hours of the inciting incident then The powers shall be granted to the Emperor (without limit) regardless.

    STATES OF EMERGENCY: In the case that the region is being threatened by an external or internal menace, any member of the government may declare a state of emergency, in this scenario, the region will be protected by password and any elections will be suspended, this state has a maximum duration of 2 weeks and can be prolonged twice but only if the Emperor decrees it, or the parliament and the Chancellor agree, if a state of emergency has come to an end, other SOE cannot be executed until a months’ time has passed.

    ARTICLE TWO - CRIMES

    MAJOR CRIMES: This charter defines the following offenses as major crimes against the region:

      1. Spying.
      2. Treason. (Actions taken within other regions, or taken before the founding of the Levellers, shall be rendered null and void and any persons convicted of such previously within the Levellers shall be pardoned, The Levellers shall NOT convict outside of the region for any reason.)
      3. Electoral fraud. (The use of puppet states/alts to artificially increase support in an election)
      4. Defy the Constitution.
      5. Plot against an elected government. (outrightly and undeniably, found to be in active planning and acting to undermine the elected government through unofficial means – the only official means is the ability of the citizens to hold a referendum – and MUST be proven to be doing so)

    In any of these cases, the involved nations may lose their citizenship, and be permanently banned.

    MINOR CRIMES: This charter defines the following offenses as minor crimes against the region:

      1. Trolling. (spamming the RMB, refusal to seriously partake in RP, etc.)
      2. Disrespect another citizen. (seriously and repeatedly harassing a citizen for expressly personal reasons)
      3. RP Cheating.
      4. Chat abuse.

    In any of these cases, the involved nations may be warned, if any nation has 3 warnings then a 2 days ban will take place, if this situation continues then it will be considered a major crime.

CHAPTER FOUR - TRIALS AND LEGAL PROCEDURES

    ARTICLE ONE - TRIALS

    A trial is a legal procedure in which a nation accused of a crime claim their innocence, therefore a fair tribunal will decide his sentence. The tribunal is composed by:

      1. A nation designated by the government (both the Chancellor and the parliament must agree on the nation).
      2. A nation designated by the Emperor.
      3. A nation elected by the region (via poll).
      4. A nation chosen by the accused nation.

    ARTICLE TWO - SENTENCES

    The tribunal can enact these sentences to guilty nations:

      1. A permanent ban.
      2. A week ban.
      3. A two-week ban.
      4. A prohibition from voting on polls/elections. (duration shall be decided by the tribunal)
      5. A warning.

    The tribunal will hear ALL ARGUMENTS before taking a decision.

CHAPTER FIVE - ANTI-DICTATORIAL POLICY AND POLITICAL TRIALS

    ARTICLE ONE - ANTI-DICTATORIAL POLICY

    In order to keep our Empire free, the state will enact the ANTI-DICTATORIAL POLICY, in which a nation with office will be permanently supervised by the citizens, therefore a member of the government or parliament can be accused of:

      1. Corruption.
      2. Illegal removal of an elected officer.
      3. Illegally modify an office.
      4. Illegally pass legislation.
      5. Remove a trial poll.

    In any of these cases, the involved nation will be removed from office and banned, in exile, a political trial will take place.

    In the event that the Emperor is accused of any of these crimes, and it is found that he is innocent, AND that the accuser has lied to spite the Emperor, said accuser nation will be removed from any office they may hold and be banned, in exile, and a political trial shall commence.

    ARTICLE TWO - POLITICAL TRIALS

    A political trial is a process in which a former officer is being accused of breaking the anti-dictatorial policy, this legal procedure is different to a common trial because there is not a tribunal, instead, the whole region will vote on the sentence, which may be:

      1. A permanent ban.
      2. A three-week ban.
      3. A prohibition from serving in office.
      4. A prohibition from voting on polls/elections.
      5. A removal from office.

CHAPTER SIX - ROLE PLAY

    The RP map and events is under the control of Bovido has and the RP moderators permanently. The Emperor, Parliament, and the Chancellor will have no influence over the map to prevent it from being used for political reasons.

CHAPTER SEVEN - MODIFICATION OF THIS CONSTITUTION

    This charter may be modified if the Chancellery and parliament agree (parliamentary agreement is considered as any majority), and the Emperor does not veto it, or if a people's poll has produced a majority.

CHAPTER EIGHT – IMPERATORIS EDICTUM AND THE EXECUTIVE ORDER LAW

    *IMPERATORIS EDICTUM:
      1. CANNOT BE PASSED BY IMPERATORIS EDICTUM
        - Cancel the will of the people, as shown in a people's vote
        - Take control of the RP
        - Attack Political Opponents
        - Remove the Courts or cancel a court ruling

      2. CAN BE PASSED BY IMPERATORIS EDICTUM IF COURT/PARLIAMENT APPROVES (which is likely)

        - Veto any laws
        - Remove MPs, WA or Diplomatic officer
        - Change the regional flag
        - Create any laws

      3. CAN BE PASSED BY AN IMPERATORIS EDICTUM

        - Open an Embassy
        - Close an embassy
        - Change government policy
        - Veto an MP vote
        - order the creation of a new discord channel
        - Edit the world fact book
        - Edit immigration policy

    **EXECUTIVE ORDER LAW:

      1. CANNOT BE PASSED BY EXECUTIVE ORDERS
        - Cancel the will of the people, as shown in a people's vote
        - Remove MPs, WA or Diplomatic officer
        - Take control of the RP
        - Attack Political Opponents
        - Remove the Courts or cancel a court ruling
        - Change the regional flag

      2. CAN BE PASSED BY EXECUTIVE ORDERS IF COURT APPROVES (which is likely)

        - Veto any laws
        - Create any laws

      3. CAN BE PASSED BY AN EXECUTIVE ORDER

        - Open an Embassy
        - Close an embassy
        - Change government policy
        - Veto an MP vote
        - order the creation of a new discord channel
        - Edit the world fact book
        - Edit immigration policy
