Current Constitution (4th reform, since August 2018)


Preamble

We, the people of the LCRUA, write and approve this constitution in order to establish a place for culture and freedom to prosper.

Definitions:

    Definitions:
    1. "the LCRUA": Our community, made up of those considered members and the regions LCRUA and The LCRUA.
    2. “visitor”: A nation which is located within The LCRUA and not a member, or, a foreign diplomat.
    3. “member”: A nation which has official membership in the LCRUA, but does not have to be located within The LCRUA. Current members can be found here.
    4. “supermajority”: A vote in which at least 2/3rd of the voters is in favour.


Section I - Rights

Description: This section contains your rights and the laws on living together within the LCRUA. These are somewhat similar to The Universal Declaration of Human Rights.

    1. Every visitor has to follow The laws of the LCRUA, but they do not have its rights until they become a member.

      A. Every visitor following our laws has the right to become a member. They must start the application process by sending a telegram to the Founder.
      B. Once the visitor has applied for membership by sending a telegram to the Founder, they will receive a question, about puppets and their reason for application.
      C. The Council has the right to not let a visitor become a member if they have the support from the Tribunal.

    2. No member’s membership can be removed without permission from the Tribunal, and they can ask at any time to be relieved from it.

    3. The LCRUA is open to everyone, whatever their political beliefs or opinion, as long as they are respectful and behave with dignity.

      A. Every member has the right to their own opinion and expression, to seek, receive and give information and ideas through any media and regardless of any frontiers.
      B. No member can be rewarded, punished or confronted based on their vote in official polls.
      C. No discrimination is allowed, including but not limited to discrimination based on age, sex, gender, sexual orientation, ethnicity, belief, background or status.
      D. Members and visitors must be respectful towards others.

    4. A member’s rights are only limited to protect the rights of others, and to allow for a functioning and just system where they are able to live and thrive in.

    5. All members are free and equal in dignity and rights.

      A. Members and visitors must behave with respect and good manners when representing the LCRUA in other regions.
      B. All members are equal before our law and have, without any discrimination, equal protection of that law. All members have equal protection against discrimination and its causes.

    6. Every member is free to stay in the LCRUA, as well as to move to or from it.

    7. Every member has the right to free choice, autonomy, security and the freedom to choose to associate.

    8. The will of our members is the basis of our democratic system.

      A. Members are able to express their will through genuine elections held by free voting procedures.
      B. Every member can take part in the government of the LCRUA, directly or through freely chosen individuals or groups.

    9. Members have the right to government transparency at all times.

      A. Each member has the right to request of the government that internal conversation related to a specific topic is made public.
      B. Each member has the right to participate in public government debates.

    10. Every member has access to any services the LCRUA offers.

    11. All members have the right to security as part of our community, the right to use all we offer for their own personal use, and the right to engage and share in our culture.

    12. Members can copy, modify and redistribute content made by other members of the LCRUA without limitations, unless stated otherwise.

    13. No member can be punished without good reason.

      A. Ever member accused of crossing our laws is presumed innocent until proven otherwise in a public trial according to our law.
      B. In a trial, every member has the right be heard by impartial and independent Judges.
      C. Suppressing, ejecting, banning, banjecting or being reported to NS moderators are punishments, but not the only ones.
      D. No member can be treated poorly or without respect.
      E. Laws can’t be used retroactively.

    14. No member’s privacy or correspondence can be violated without permission from the Tribunal. False accusations or attacks upon a member’s honour and reputation are not allowed.

      A. Every member has the right to protection against such violations or attacks.
      B. Every member has the right to be helped by the Council when one of their rights described in this Constitution is violated.



Section II - The Government
Description: This section defines the available positions in the LCRUA’s government, the responsibilities of each position, and the rules the government is bound by.

    1. The LCRUA’s government is the Council, consisting of five Councillors who each lead their own department(s). One Councillor, the Council Chair, represents the Council as its executive officer and sets the Council agenda.

    2. Each Councillor:

      A. Has access to the regional controls over Polls, Embassies, Communication and Appearance.
      B. Is responsible for completing the tasks essential to the continued function and governance of the region, as determined by the Council Chair. Councillors should take initiative when they have no tasks.
      C. Can create and develop their own department(s) in the way they see fit, as long as any authority or responsibility they grant to others is part of theirs.
      D. Has the right to appoint and dismiss the Council Chair from among themselves by majority vote at any time in accordance with the regulations stipulated below.

    3. The Council Chair:

      A. Is appointed, if no other Council Chair exists at the time, when any Councillor other than the one who last held the office motions to become the Council Chair, and the motion is carried by the Council's majority vote.
      B. Is obligated to set a reasonable agenda wherein responsibilities are assigned to the Council and keep the other Councillors on task, and expected to abdicate the Council Chair position upon that agenda's completion.
      C. Is obligated to announce when a Councillor has not been in contact with the region in any way for at least five days without prior approval from the Council.
      D. May resign, or be dismissed by the Council's majority vote, whereupon a new Council Chair must be chosen by the appointment process above.
      E. Must be selected by the Tribunal and ratified by the Council's majority vote in the event that no Councillors are otherwise willing and/or eligible.

    4. Tasks are not limited to the ones below, but these are essential to keep the region functioning:

      A. The Council must regularly discuss matters at hand and review how it is doing.
      B. Legislation must be archived and updated according to changes, and legislative polls must be held when proposals are available.
      C. The RMB must be moderated, so that it is kept relatively decent.
      D. The public must be kept informed on whatever goes on in the LCRUA, through the use of regional telegrams and the regional newspaper.
      E. Embassies and diplomatic ties with other regions must be managed and maintained.
      F. Roleplays must be provided and nurtured, and regional culture promoted.
      G. The region must be kept internally cohesive, disputes must be resolved, and new members must be welcomed.
      H. Offsite links and forums must be upheld and maintained.



Section III – The World Assembly
Description: These are the laws regarding the WA-Delegate, endorsements and military gameplay.

    1. The WA-Rules:

      A. Every WA-nation in the LCRUA must endorse its legal WA-Delegate and Security Officers.
      B. Every nation in the LCRUA must have less endorsements than the legal WA-Delegate.

    2. The WA-Delegate is the primary authority in the World Assembly, where they promote the LCRUA, its ideas and its best interests.

      A. The WA-Delegate can be replaced by the council with a supermajority vote, or by a referendum.
      B. The WA-Delegate is temporarily replaced by a Security Officer when they resign, cease to exist, or are replaced, until a new WA-Delegate is chosen. A poll will be held with all of the nominees the Council and Tribunal selected to determine the WA-Delegate.

    3. Security Officers have access to Border Control and safeguard our region from hostile forces.

      A. Each Security Officer is nominated by the Council and Tribunal based on their trustworthiness, nation's WA-status, endorsement count and/or Soft Power Disbursement Rating (a.k.a. “Influence”) in our region. A poll will be held with all of the nominees the Council and the Tribunal selected to determine the Security Officer.
      B. A Security Officer keeps their role for life, until they resign, until their nation ceases to exist, or until the Council removes them with a supermajority vote (whichever happens first).

    4. On interregional raiding and defending organizations: The LCRUA declares itself a neutral region, the region cannot join any interregional organization dedicated to raiding or defending.

      A. Raiding is defined as the act of a group of nations from outside a region who move in and endorse each other, with the objective of taking the position of World Assembly Delegate.
      B. Defending as the act of nations by outside a region of moving in to prevent a successful raid, raid the raided region to give it back to its original owners, or otherwise disrupt raiders with the objective of weakening their ability to raid.
      C. If an interregional organization the LCRUA is part of is deemed by LCRUA members to have become a R/D organization, they may vote in behalf of the region to withdraw from it.
      D. Any nation in the LCRUA is free to participate in raiding and defending as they please, as long as it does not harm the LCRUA.



Section IV - Elections
Description: This section describes how and when elections for each position are held.

    1. The Council is elected once every two months, on the 25th and 26th of January, March, May, July, September, and November.

      A. Apart from Judges and Security Officers, any official member of the LCRUA is eligible to stand candidate, and can do so by announcing their candidacy on the RMB on or before the 23rd of the month of the election.
      B. All Councillors have their seats up for election.

    2. The election is decided by a form of ranked-choice voting, as described below.

      A. Any member can submit a list of some or all of the candidates (excluding themself), ranked from their favorite to their least favorite (their "ballot").
      B. Each candidate is awarded a number of points from any given ballot equal to the total number of standing candidates (minus one if the ballot comes from a fellow candidate) minus their ranking on the ballot.
      C. Any member can submit their ballot by sending a telegram to all of the current Judges.
      D. At the end of the election period, the Judges will tally the votes and one of them must make a post to the RMB about the results.
      E. This post must include the final scores of all of the candidates and the names of all of the voters, but must not include any information about who each member voted for and/or in what order.
      F. The top five point-scorers as named in said post are elected to be the new Council, to take office on the 1st of the following month.
      G. If the results of the election are indecisive, the election shall be extended to the 28th of the month of the election.
      H. If the results of the election are still indecisive after the extension, the relevant tie shall be adjudicated by the Tribunal.
      I. If the election is in violation of any of these rules, it may be declared invalid by the Tribunal, with the current Council remaining in power until a replacement election can be held.

    3. If a Council seat is left vacant for any reason, a by-election (using simple plurality) must begin within 3 days and must finish within 4 days.

    4. Tribunal appointment process:

      A. When a position on the Tribunal becomes vacant, the Council must immediately begin the search for a replacement.
      B. With the exception of Councillors and Security Officers, any official member of The LCRUA can be recommended to be a Judge.
      C. After a Councillor has set a recommendation, the Council votes on whether they agree with the recommendation or not.
      D. To get appointed to the position, at least four Councillors need to support the recommendation.



Section V – Polls, Proposals, and Referenda
Description: Here is defined how legislative proposals, official polls, and referenda work.

    1. All official polls are made by a Councillor.

      A. All options must be clear and can't be inclined towards a personal opinion.
      B. The Councillor who made the poll must inform the region about it at its start, and share the results with the region when closed.
      C. The result of an official poll defaults to simple plurality, unless stated otherwise in our law or the description of the poll itself.
      D. A poll may be held on-site or off-site, in accordance with its requirements. Off-site polls must be archived on-site.

    2. Each member has one vote, and every member has the right to vote in official polls.

      A. Voting is not compulsory.
      B. Members can vote once with either their main nation or one of their recognised puppets.
      C. Multiple votes by the same person are against our law, and all votes of that person are counted as blank.

    3. A legislative proposal can be made by any member.

      A. A proposal can be polled if more than 50% of the Council approves.
      B. Proposals not approved by the Council can be polled by referendum.

    4. Once a proposal has been approved, a poll is created by a Councillor.

      A. The poll must include a link to the proposal, and must be named after the proposal.
      B. The options of the poll must include "Approve", "Reject", "Amend" and "Abstain", which are always the basic options of the poll.
      C. The 4 options are defined as follows:
      - APPROVE: the voter supports the proposal.
      - REJECT: the voter rejects the proposal.
      - AMEND: the voter shows they reject the proposal in its current state.
      - ABSTAIN: the voter neither supports nor rejects the proposal.
      D. Once polled, a proposal can’t be changed.

    5. Each member has the right to call for a referendum when they can prove at least 5 members support it.

      A. A referendum must be announced to the whole region via telegram at its start.
      B. A Councillor may not refuse to announce or organise a referendum with the necessary supporters.
      C. A referendum needs more than 50% votes FOR in it's poll to be successful.
      D. A referendum can change a law when there is a lack of government support.
      E. A referendum can render an edit to legislation unconstitutional.
      F. A referendum can remove a punishment from a punished nation.
      G. A referendum can remove a Judge from their position.
      H. A referendum can remove a Councillor from power.
      I. A referendum can remove the WA-Delegate from power.
      J. A referendum can dismiss the Council Chair, whereupon a new Council Chair must be appointed.



Section VI - Justice and Law
Description: The justice system and regulations for our law are explained here.

    1. The Tribunal consists of three Judges and the Security Officers.

    2. The Tribunal presides over trials in the LCRUA. The Tribunal has the responsibility to decide on a just punishment in trials and resolve legal disputes.

    3. Any nation in the LCRUA can accuse any other nation of violating our law if they have proof or valid suspicions, in which case a trial is held.

      A. The accuser is represented by a prosecutor, or can choose to represent themselves.
      B. The accused is represented by a lawyer, or can choose to represent themselves.
      C. The prosecution and defence get the chance to present their arguments to the Tribunal. The defence has the last word except for the Judges.
      D. If the accused pleads not guilty, the Judges decide whether the accused is guilty or not based on proof presented by the prosecution.
      E. If applicable, the Judges decide on a just punishment.
      F. The Security Officer(s) make sure any punishment is enacted.

    4. Any member can ask the Tribunal to settle a legal dispute or irregularity in case our laws are not clear enough. The Tribunal can issue an official interpretation of disputed laws and can propose changes if necessary.

    5. Security Officers are allowed to ban any visitor(s) without trial to safeguard the region's security.

    6. This Constitution and addenda are the only legal legislation in the LCRUA. It applies within the LCRUA and to its members.

      A. It can not be changed without public approval, with the exception for changes allowed by this Constitution.
      B. It must be worded in simple English where possible.

    7. Errors in the law may be fixed without public approval.

      A. An error in the law is defined as a typographical mistake or a law that is invalid.
      B. Laws can be invalid if overruled by higher or more recent law, in that order of importance.
      C. The hierarchy of law: the Constitution stands above addenda and articles stand above clauses.
      D. Anyone fixing errors in the law must have permission from the Tribunal.
      E. A Councillor may fix errors in the law if more than 50% of the Council approves.
      F. The Tribunal may reverse an error fixed by the Council.

    8. All legislative changes must be archived.

      A. The archive must contain every change made to the law.
      B. Laws within the archive contain links to relevant polls and when a footnote stating whether they are in effect, changed or repealed.

    9. After the result of an event with legal impact (official polls, membership requests, trials, etc.) is known, executing the required changes must be done within 24 hours.
